1. Complaining of unjustified denial of third financial upgradation
under the Modified Assured Career Progression Scheme (hereafter called
"MACPS ... action impugned is the denial of their claim for a third financial
upgradation. The petitioners challenge an order of the Screening
Committee of the High

the grant of the 3rd Financial Upgradation under the Modified Assured
Career Progression Scheme (MACPS) issued by the Department ... grade pay of `6600/- in Pay Band-3 as
their third financial upgradation on completion of 30 years under the said
MACPS. According
petitioners are seeking the second financial upgradation under
the Assured Career Progression Scheme (ACP) on having completed 24
years of regular service. They are claiming ... financial upgradation to the pay
scale of `5000-8000 under the said ACP scheme on 09.08.1999.
3. The only point of contention is whether
Government Health Service (CGHS,
for short) would be entitled to three financial upgradations in the grade pay
of Rs.4600, 4800 and 5400 without taking ... dated 19.5.2009, every
financial upgradation under the Scheme has been
treated as one upgradation and would be offset against
one financial upgradation. Accordingly, the grade
