Ranpur Gram Panchayat to allot 45 acres of land
from the gaucher land of village Ranpur for rehabilitation /
allotting the aforesaid land to the persons ... transfer the 45 acres of land to the State
Government from the gaucher land submitting that the village has only
140 acres of land
impugned order passed by the
Collector, Sabarkantha dated 2.4.2003 in resuming the gaucher land in
question from the management of petitioner Varthu Gram Panchayat ... management of the gaucher land in question was given to the Varthu
Gram Panchayat and it was found that Panchayat has failed to protect
submitted that looking to the number of cattle, the requirement of
gaucher land would be 430 hectares i.e. approximately 1000 acres. It
is further ... submitted that at present only 80 hectares gaucher land is
available. Thus, considering the above, it appears that requirement
of gaucher land is much more
petitioner
has submitted that the concerned persons have encroached upon the
gaucher land and the parties to the suit in collusion with each
other, will ... that encroachment on the gaucher land is not
removed and, therefore, to protect the gaucher land, presence of the
petitioner is required.
3. The
aforesaid
persons
inclusive of Gujarat Heavy Chemical Ltd., illegally excavated
limestone from the gaucher land and committed the theft of limestone
worth Rs.53 lacs
case before the Division
Bench the State Government resumed the gaucher land for public
purpose which was challenged on the ground that by such resumption ... belonging to Scheduled Castes and backward
communities, there was a reduction of gaucher land. It is not so in
the present case
constituted
and the same team has been directed to regularly supervise the
gaucher land of Zarpara village and to look after the said land ... purpose
for which it is reserved (gaucher land).

this, present application is disposed of.

of allotment of gaucher land has been reconsidered by the Collector
and a fresh order
applicants that as such all the
applicants are not on the 'gaucher' land but they are on the 'gamtal'
land
filed any reply and defended their policy of
divesting the Gaucher land for industrial purpose. Shri NK Raval,

Government of divesting the gaucher land for industrial purpose
deserve to be considered and the same can be considered
