Ranpur Gram Panchayat to allot 45 acres of land
from the gaucher land of village Ranpur for rehabilitation /
allotting the aforesaid land to the persons ... transfer the 45 acres of land to the State
Government from the gaucher land submitting that the village has only
140 acres of land
petitioner
has submitted that the concerned persons have encroached upon the
gaucher land and the parties to the suit in collusion with each
other, will ... that encroachment on the gaucher land is not
removed and, therefore, to protect the gaucher land, presence of the
petitioner is required.
3. The
aforesaid
land was acquired before three years and there as no gaucher land available for the cattle and as the petitioners had not occupied other lands
persons
inclusive of Gujarat Heavy Chemical Ltd., illegally excavated
limestone from the gaucher land and committed the theft of limestone
worth Rs.53 lacs
brief fact of the petition is that
there is a government gaucher land bearing Survey No. 208 paiki,
situated at village Chhaya, Taluka and District
wrongly confiscated and later on identified and
declared as gaucher land. That the District Collector by order dated
05.03.2008 held that the land in question ... already placed under
the head of gaucher land, no regularization of the said land could be
ordered. Being aggrieved by the order of the Deputy
subsequently the
land has been kept reserved by the authority as forest gaucher land.
Public purpose is involved in the status now given ... same was declared as forest land and now is
treated as forest gaucher land.
7. The challenge to the order passed by the Revisional Authority
petitioner's
daughter aged about 5 years, is suffering from gaucher
disease. It is further submitted that the facility of
treatment of the aforesaid
petitioner's
daughter aged about 14 years, is suffering from gaucher
disease. It is further submitted that the facility of
treatment of the aforesaid
petitioner's
daughter aged about 4 years, is suffering from gaucher
