caste is a sub-tribe within
the meaning of Entry 19 (Halba/Halbi) of the said Scheduled
Tribes Order relating to State of Maharashtra, even ... Koshti"
caste and that he did not belong to "Halba/Halbi" Scheduled
Tribe. The appellate authority went to the extent of saying
Koshti" is a sub-caste of
"Halba" or "Halbi" came up for consideration before a Division Bench of
the Bombay ... Koshti does not form part and parcel of
Tribe "Halba' Halbi". It is thus clear that the
enquiries undertaken by several authorities

C The Halba / Halbi controversy
9 The Constitution (Scheduled Castes) Order 1950 and the Constitution
(Scheduled ... Scheduled Tribes for the State of Maharashtra, Entry
19 is :
“Halba, Halbi”
10 In the State of Maharashtra, the ambit of Entry 19 became
Divisional Magistrate, Pusad, District Yavatmal, certifying that the
appellant belongs to the `Halbi' Scheduled tribe, notified in terms of
the Constitution (Scheduled Tribes) Order ... these documents recorded the Caste of
those persons as `Halbi'.
4. Not being satisfied with the documentary evidence produced by the
appellant, the Caste

Attempts were made over a period of time by certain ... schedule to the

The Act removed that area restriction as a result all Halba/ Halbis in the State were included in the relevant entry.
2. The principal

were declared to be Scheduled Tribe for the State of Madhya Pradesh ... formation of the State of Chhattisgarh in the year 2000, these
Halba/Halbi were also Scheduled Tribes for the State of Chhatisgarh.

only because of
apprehension that old documents mentioning tribe as 'Halbi' could have
been referring to tribe 'Koshti Halbi', the caste ... finding that
the said test proved that the petitioner belongs to 'Halbi Koshti' tribe.
