petitioner,
for his personal reasons, resigned from service of the corporation.
His resignation became effective from 16.1.1995.
2.9 After
about 7 years, since his retirement ... made effective from
16.1.1995.
7.18 Thus,
the petitioner resigned from service and his resignation became
effective from the date subsequent to the date of said
postulated day and the
company was bound to give effect to the withdrawal of resignation.
In the above reported judgment, the employee was not allowed ... Court and
held that the employee had withdrawn his resignation before it was given effect
to by the Employer and therefore, granted the relief prayed
case of voluntary retirement on completion of qualifying service. The effect of resignation and retirement to the extent that there is severance of employment ... duress or coercion is not at all a resignation and hence treated the said resignation as voluntary retirement, so as to entitle the employee
will be the Executive Committee.
17. Article XXI deals with RETIREMENT AND RESIGNATION and it reads as follows:
i) Except the General Secretary on deputation ... resign shall tender his written resignation at least one month in advance of the date from which he intends his resignation to take effect failing
stated that the teacher who had
availed leave had resigned from service and the said resignation
was duly accepted and approved ... submitted resignation and
the petitioner was accommodated against the resignation
vacancy. The resignation had been accepted by Ext.P3 with
effect from
training but after 5 weeks, submitted his
resignation on 27.07.2009. The petitioners submitted that after
receiving the resignation, the said Shri Lalit Kumar was asked ... consumed, in the
event of any vacancy arising later, on account of resignation or
otherwise, the same could not have been filled up from
vacancies advertised, 40 candidates have been appointed
out of which 05 have resigned or not joined. Therefore, the candidates much
more than the vacancies advertised ... select list stands exhausted with the joining of the candidates. The resignation of
few candidates after their joining, does not entitle a waiting list candidate
vacancies. They were appointed on 14.12.1987. One
person, out of 40 appointed, resigned.
