recognized by the Eastern Regional Committee of
the NCTE under Section 14 of the NCTE Act, 1993, and that under
the said Section 14 ... such
institutions, as provided under Section 16 of the NCTE Act, 1993.
Section 16 of the said Act reads as under:
"16. Affiliating body
procedure
laid down in Proviso to sub-Section (3)(b) of Section 14 of NCTE Act,
which provides that before passing any order under ... does not indicate
compliance with Proviso to sub-Section (3)(b) of Section 14 of NCTE Act

57. Under Section 14 and particularly in terms of Section
14(3) (a) of the Act, the NCTE is required to grant or refuse ... under section 14 or permission for a course
or training under section 15 of the Act.
17. Sub-section (6) of section 14 no doubt
Act 18 of 2011, sub-Section 12A was inserted in
the National Council for Teacher Education Act, 1993 (hereinafter referred to as the
' NCTE ... mention in the provision of Section 2(e) of the NCTE Act, 1993.
14. Section 2(e) of the NCTE Act, 1993 defines 'institution
procedure laid down in Proviso to sub-Section (3)(b) of Section 14 of NCTE
Act, which provides that before passing any order under ... does not indicate
compliance with Proviso to sub-Section (3)(b) of Section 14 of NCTE Act
which mandates that opportunity of making a representation
fall in the category of an institution.
Therefore the NCTE Act Section 14 is not
applicable.
13. The learned counsel for the applicant
submitted that ... NCTE.
17. Heard the parties and perused the
documents on record.
18. As noted above, Section 14 of the NCTE Act
mandates that courses offering
contravention to the
provision of Section 14(6) of the NCTE Act, 1993 and there is no
provision in the Act to keep in abeyance ... subject to
obtaining recognition of the NCTE as provided in Chapter - IV, Section 14 of the
NCTE Act, 1993 before applying for affiliation. There
