challenged in the writ
petition, is an ex parte order and certain strictures have been passed
against petitioner No.2 without affording any opportunity ... ground taken
in the writ petition that there were certain strictures passed by the
Chairman, BOG of the respondent-Institute against petitioner No.2 while
which
reads as follows:-
"16.38 Criminal offences by police officers and strictures by
courts-Procedure regarding.- (1) Where a preliminary
enquiry or investigation into ... making it obligatory on all civil and criminal
courts, whenever they make strictures on the personal
character or professional conduct of a police officer
delivered the judgment dated 22.9.1986
(Annexure P-4) wherein it passed certain strictures against him which
were without affording an opportunity to explain his position ... basis of the said strictures he was placed under suspension vide order
dated 13.7.1987 and was only reinstated on 22.7.1988. Thereafter, a
charge sheet
extracted as under:-
"16.38. Criminal offences by police officers and
strictures by courts procedure regarding.
(1) Where a preliminary enquiry or investigation

and criminal courts, whenever they make strictures on the
personal character of professional conduct of a police

Rules which read thus:-
16.38. Criminal offences by police officers and strictures by courts
procedure regarding. (1) Immediate information shall be given ... making it obligatory on all civil and criminal courts, whenever they make
strictures on the personal character of professional conduct of a police
officer
convicting the accused in that case on 31-10-1957, passed certain strictures against Mr. Sat Pal, Advocate of Patiala, who was defending the accused ... necessary for the purposes of the present order to detail the strictures except to say that, if correct, they amounted to professional misconduct

observations and strictures against him which could not have
been done without a notice ... order passed by
Chairman, Board of Governors, shall not be taken as strictures
against petitioner No. 2.
