Arbitrator failed to
consider that proceeding before Ld. Sole Arbitrator under section
29A and 29B of Act 1996. The impugned award is against
principle ... regard to
the petitioner and Ld. Arbitrator was requested to enter into
reference of Arbitrator/ Proper compliances has been made by Ld.
Arbitrator. Proper time
never
received by the petitioner and even after the arbitrator
entered the reference no notice was received by or on behalf
of the Arbitrator ... that Ld. Arbitrator proceeded exparte
in a haste and no notice was given. On 20.07.2016 the Ld.
Arbitrator had entered the reference and issued notice
only filed reply to the claim of the
petitioner before the Ld. Arbitrator but also made a counterclaim
wherein it claimed that the petitioner ... against the petitioner.
7. The Ld. Arbitrator upon entering reference and on hearing
both the sides, passed the impugned Award wherein the claim laid before
proceedings conducted by Arbitrator, vide letter
dated 08.10.2016, he was nominated as sole arbitrator to adjudicate
upon the dispute on 07.11.2016, whereupon, he directed ... both the parties for their appearance for 07.11.2016. On
07.11.2016, Arbitrator entered into reference on the arbitration matter
and observed that despite service of notice
Arbitration and Conciliation Act for appointment of
arbitrator. Respondent no.2 entered upon reference vide his letter dated
15.10.2008 and directed respondent ... over and above the contracted rate. Vide order dated
28.08.2009, Ld. Arbitrator directed the petitioner to inform the charges that
are leveled upon a person
