Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner has been made accused in Case No.R.C 1(A)/2003 (D) for the offence under Sections 120B, 420, 467, 468, 471 I.P.C read with Section 13 (2) & Section 13 (1) (d) of the Prevention of Corruption Act.

The case relates to the commission of wrongful loss to the Council of Scientific & Industrial Research Institute in making purchases by the various officials of the Institute to the tune of Rs. 50 Lakhs. So far as this petitioner is concerned, it is alleged that he used to collect the illegal gratification on behalf of the Director, Sri T.N.Singh, who was the main accused in this case.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case the other co-accused persons, against whom there are allegations, including the Director Sri T.N.Singh, have been granted anticipatory, or regular bail in this case.

In the facts of this case, particularly in view of the fact that other co-accused have been granted bail, I am inclined to release the petitioner on bail. Accordingly, the petitioner Jyotish Chandra Saha is directed to be released on bail, on furnishing bail bond of Rs. 20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Sri Madan Mohan Singh, learned Additional Sessions Judge-I- cum- Special Judge, C.B.I, Dhanbad in Case No.R.C 1(A)/2003 (D).
