Author: Dipankar Datta

Bench: Dipankar Datta

1 09.09.2016 AJ.

W.P. 19364(W) of 2015 Kaiyum Momin & Ors.

-Vs-

The State of West Bengal & Ors.

Mr. Somnath Banerjee, Mr. Sumanta Chakraborty.

.......for the Petitioner.

Mr. Sadhan Kumar Haldar, Mr. Abdus Salam.

.......for the State.

It is submitted by Mr. Banerjee, learned advocate for the petitioners that deficit court fees have been put in vide filing no. A-22735 dated 26th November, 2015. Therefore, the writ petition shall be maintainable at the instance of all the petitioners.

The petitioners applied for benefits under Indira Awas Yojana. Such applications not having been considered, this writ petition has been presented before this Bench.

It has been brought to the notice of this Bench that the Indira Awas Yojana (Scheme) has been restructured into Pradhan Mantri Awaas Yojana-Gramin (PMAY-G) with effect from 1st April, 2016. It has not been shown to this Bench that applications for benefits under Indira Awas Yojana shall be treated as applications under PMAY-G. In that view of the matter, the petitioners' earlier applications cannot be treated to be pending. This writ petition stands disposed of granting liberty to the petitioners to apply under PMAY-G before the appropriate authority and if such applications are received, the appropriate authority shall proceed to consider and dispose of the same in accordance with law. 2

There shall be no order as to costs.

Urgent photostat certified copy of this Order, if applied for, be supplied expeditiously after complying with all necessary legal formalities.
