ORAL ORDER
14 01-12-2014I.A. No. 8783 of 2014 Pursuant to the earlier order of this Court dated 30 Patna High Court CWJC No.5638 of 2011 (14) dt.01-12-2014 31 22.10.2014, this application has been filed enclosing the details of 20 districts, but it is said that for the remaining 18 districts, such details can be furnished only within the period of next two months. Enclosure to the application containing the details shall be available for inspection for the learned counsel for the petitioners which is in addition to its being already published on the website of the department.
Having regard to the enormous task being faced by the Principal Secretary of the Rural Development Department, this court would accede to the prayer made in this interlocutory application by granting further two months time to complete the details in respect of all the districts of the State of Bihar. Such consolidated list of all the 38 districts shall be displayed on the website of the department on or before 1st of February, 2015 and a copy thereof shall also be made available to this Court within the same period.
Let this period of two months be also utilized by 31 Patna High Court CWJC No.5638 of 2011 (14) dt.01-12-2014 32 the departmental Secretary in issuing show cause notice to all concerned i.e. the P.D.S. dealers as well as the concerned officials and also by publishing the same in the newspaper for eliciting their response/reply if any and also considering them before making the final determination of the individual liability to be fastened against the erring P.D.S. dealers and/or the concerned officials.
With the aforesaid observations and directions this interlocutory application is disposed of.
C.W.J.C No. 5638 of 2011 Put up this case alongwith its analogous cases again under the same heading on 11th of February, 2015 at 2:15 pm as a tied up matter when the Principal Secretary, Rural Development Department shall again remain present.
