3/ 13.07.2018      Heard learned counsel for the parties.

Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioners.

Petitioners are accused for allegedly committing the offence punishable under Sections 364/120(B) of the Indian Penal Code (subsequently added Sections 302/201 of the Indian Penal Code and Section 27 of the Arms Act) in connection with Telco Police Station Case No.208 of 2017 corresponding to G.R. No.3147 of 2017, pending in the Court of learned Judicial Magistrate 1st Class, Jamshedpur.

This is a case of kidnapping of son of the informant and his murder. There is no eye witness to the said occurrence. Name of these petitioners transpired from the confessional statement of Uday Choudhary.

Learned counsel for the petitioners submit that save and except the confessional statement, there is nothing against the petitioners and there is no recovery from the possession of the petitioners.

Taking into consideration the aforesaid facts, petitioners, abovenamed, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st -: 2 :- Class, Jamshedpur in connection with Telco Police Station Case No.208 of 2017 corresponding to G.R. No.3147 of 2017, with a condition that the petitioners will appear and mark attendance before the Officer-in-Charge, Telco Police Station, Jamshedpur once a month and in the event the petitioners fail to appear before the Officer-in-Charge, Telco Police Station in any particular month, bail bonds furnished by the petitioners shall stand cancelled and the Officer-in-Charge, Telco Police Station will take all steps for arresting the petitioners again.
