ORAL ORDER
7 11-02-2022Heard the parties through video conferencing.
2. All these matters listed today before this Court are arising out of complaint cases where the petitioner(s) has/have moved bail applications under Section 438 of the Criminal Procedure Code seeking anticipatory bail on apprehension of being arrested after they have been summoned by the trial Court. Several of the cases are where the concerned Magistrate has taken cognizance and issue summons or issued warrants. This Court has raised following points to be addressed by the respective counsels :
(i) In case where cognizance has been taken by the learned Magistrate for offence under Section 498(A) of the Indian Penal Code or any other non-
bailable offence and issues summons to the accused, whether the bail application under Section 438 of the Criminal Procedure Code would be maintainable.
(ii) If the learned Magistrate issues non-bailable warrant of arrest for procuring the attendance of Patna High Court CR. MISC. No.57376 of 2019(7) dt.11-02-2022 39/43 the accused in such cases referred above whether bail application under Section 438 of the Criminal Procedure Code would be maintainable.
3. Today it has been pointed out by the counsels that the question raised by this Court as above is almost identical to the question referred to the larger Bench by the coordinate Bench vide its judgment dated 25.09.2014. Following questions are framed by the coordinate Bench.
(i) The validity of exercise of the rights if any and their entitlement of privilege under Section 438 of the Code by an accused in complaint case wherein after enquiry the Courts simply issues summons.
(ii) Whether Additional Sessions Judge of any Sessions Division acting as a Special Court exercising powers as of a Magistrate only can also be treated as Court of Session for the purposes of Section 438 of the Code ?
(iii) Whether an application under Section 438 of the Code is filed before the Court of Session second application before the High Court can also be preferred ?
4. The first question is almost identical to the points raised by this Court.
5. It is noticed that after aforesaid reference another coordinate Bench vide its judgment passed in Salim Ansari Vrs. Patna High Court CR. MISC. No.57376 of 2019(7) dt.11-02-2022 40/43 State of Bihar, reported in 2015(3) P.L.J.R., 806 has observed that the Magistrate who has issued summons ought not send the accused in judicial custody in a mechanical fashion.
6. Another coordinate Bench vide its judgment reported in 2017 (2) P.L.J.R., 6 (Munni Khatoon Vrs. State of Bihar) has also opined that the bail application would be maintainable in cases of apprehension of arrest where summons have been issued by the learned Magistrate.
7. One of the counsels appearing before me has also informed that Full Bench of Calcutta High Court has in its judgment reported in 2003 CriLJ., 2815 (Shamim Ahmed And Ors., Haradhan) taken a similar view.
8. It is also to be noticed that a larger Bench has been constituted to exercise the questions raised (suupra) in Cr. Misc. No. 19124 of 2014 (Anil Kumar Vrs. State of Bihar and connected matters). The Full Bench on 06.12.2018 deferred the issues in following terms :
"At the very outset, it was pointed out that 1 st issue which has been referred to this Full Bench has direct bearing with one of the issue which has recently been referred by Hon'ble Supreme Patna High Court CR. MISC. No.57376 of 2019(7) dt.11-02-2022 41/43 Court to the larger Bench. The Hon'ble Supreme Court in a case reported in (2018) 7 SCC 731 [Sushila Aggrawal And Others Versus State (NCT Of Delhi) And Another] has referred an issue i.e. "Whether the life of an anticipatory bail should end at the time and stage when the accused is summoned by the Court ? to the larger Bench. Since the core question in the present case regarding testing the rights of an accused summoned in a case to avail the privilege of anticipatory bail has already been referred by the Hon'ble Supreme Court to larger Bench, we propose to defer the hearing in the present case awaiting final result of the Hon'ble Supreme Court in the case of Sushila Aggarwal (supra)."
9. Since, the Supreme Court has now decided the question as noticed here-in-above in (2018) & SCC 731 [(Sushila Aggarwal & Ors. Vrs. State (NCT of Delhi)] vide its judgment reported in 2020 (5) SCC 1 [(Sushila Aggarwal & Ors. Vrs. State (NCT of Delhi)] in the circumstances wherein the Supreme Court has answered the question as under :

No.57376 of 2019(7) dt.11-02-2022 42/43 Re question no. 2 : Whether the life of an anticipatory bail should end at the time and stage when the accused is summoned by the court "83 : Therefore, unless circumstances to the contrary: in the form of behaviour of the accused suggestive of his fleeing from justice, or evading the authority or jurisdiction of the court, or his intimidating witnesses, or trying to intimidate them, or violate any condition imposed while granting anticipatory bail, the law does not require the person to surrender to the court upon summons for trial being served on him. Subject to compliance with the conditions imposed, the anticipatory bail given to a person, can continue till end of the trial.
This answers Question 2 referred to the present Bench."
10. Thus, the Supreme Court has not examined the issues as raised before the larger Bench as well as before this Court. Therefore, now it is thereafter left best for the Full Bench of this Court to examine the issues referred to above and, therefore, I refrain from deciding these bail applications finally.
11. However, taking into consideration aspects and judgments as cited above, I am inclined to grant interim relief to all the petitioners and direct that till the decision of the larger Patna High Court CR. MISC. No.57376 of 2019(7) dt.11-02-2022 43/43 Bench the petitioner(s) shall not be arrested. The Registry is directed to list all these bail applications before the larger Bench, which is to hear Cr. Misc. No. 19124 of 2014 (Anil Kumar Vrs. State of Bihar and connected matters). The counsels may make a request to the Registry to get the larger Bench formed at the earliest.
