01. 1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner is an accused in connection with S.T. Case No.52 of 2021, pending in the Court of the learned Additional Sessions Judge, Salipur, arising out of Salepur P.S. Case No.177 of 2021, for alleged commission of offences under Sections 376(2)(n)/506 of IPC.

3. Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Salipur, by order dated 04.02.2023 in the aforementioned case, the present BLAPL has been filed.

4. Perused the order of rejection.

5. This is the second journey of the petitioner to this Court Ex facie his bail application is being moved before the time limit fixed for conclusion of trial.

6. Considering the same, this Court is not inclined to entertain this bail application at this stage.

7. Liberty is granted to the petitioner to renew his prayer before the learned Court in seisin in the event trial is not concluded by the date fixed.

8. Accordingly, the BLAPL stands disposed of.

9. Urgent certified copy of this order be granted as per rule.
