Section 48 in Tamil Nadu District Municipalities Act, 1920

48. Qualification of candidates.

- [(1) No person shall be qualified for election as a [chairman or as a councillor] [Sub-section (1) of section 48 was substituted by Tamil Nadu Act 32 of 1980] unless-](a)his name is included in the electoral roll of the municipality; and(b)he has completed his twenty-five years of age.
(2)[ No officer of Government [including] [This sub-section was substituted for the sub-section (2) by section 40 of the Tamil Nadu District Municipalities (Amendment) Act, 1930 (Tamil Nadu Act X of 1930)] a village officer shall be qualified for election or for holding office as [chairman or as a councillor] [Substituted for 'councillor' by Tamil Nadu Act No. 15 of 2011, dated 06.09.2011, w.e.f. 12.9.2011.]:Provided that this prohibition shall not apply to the holder of any office which does not involve both of the following incidents, namely, that the incumbent-
(a)is a whole-time servant of the Government; and
(b)is remunerated either by salary or fees:
Provided further that if any question arises either before or after an election whether any person is or is not disqualified under this sub-section, the question shall be referred to [State Government] [The words 'Provincial Government' were substituted for the words 'Local Government' by the Adaptation Order of 1937 and the word 'State' was substituted for 'Provincial' by the Adaptation Order of 1950.] whose decision shall be final.]
