This writ petition is filed under Article 226 of the
Constitution of India, praying to declare that Karnataka Police
(Amendment) Act, 2021 (Annexure-A) as ultra vires the
Constitution & etc.
This petition coming on for Preliminary Hearing, this
day, Alok Aradhe J., made the following:
ORDER
1. With the consent of the learned Counsel for the parties, the matter is heard finally.
2. In this writ petition, the petitioners inter alia have prayed for the following reliefs:
A. Issue a writ, order or direction under Article 226 of the Constitution declaring that Karnataka Police (Amendment) Act, 2021 (@ Annexure-A) as ultra vires the Constitution of India;
B. Issue a writ, order or direction under Article 226 of the Constitution declaring that the expression 3 "pure game of skill" in Section 176 of the Karnataka Police Act, 1963 means "mere skill" or games mainly and preponderantly a game of skill.
3. When the matter was taken up today, learned Counsel for the parties fairly submit that the controversy involved in this writ petition is squarely covered by the judgment of this Court dated 14.02.2022 passed in W.P.No.18703/2021 and other connected matters.
4. In view of the aforesaid submission and for the reasons assigned in the aforesaid judgment, this writ petition is disposed of on the same terms and with similar directions.
