Author: Abhijit Gangopadhyay

Bench: Abhijit Gangopadhyay

Court No. 17 WPA 23416 of 2022

30.03.2023

Ali Hossain Mandal & Ors.

(A 4) Vs. The State of West Bengal & Ors.

(S. Banerjee) Mr. Dibyendu Chatterjee Mr. Pritam Majumdar Mr. Rahul Deb Goenka Mr. Sourish Ghosh ... for the petitioners Mr. Saikat Banerjee Mr. Ratul Biswas Mr. Kaushik Chowdhury ... for the WBBPE Mr. B. Basu Mullick ... for the DPSC, Hooghly The petitioners pray for TET pass certificate which has not been given till date though the petitioners qualified in TET in the year 2014. Thereafter by an order passed by this court on 8th April, 2019, the court directed the Board to grant TET certificates without any further delay and within two months, which has not been done till date. However, from this order an appeal was preferred wherein some suggestions were made by the Board as is reflected from the order passed by the Division Bench in MAT 808 of 2019 where the court has dealt with the suggestions of the Board. This Division Bench order is of 03.02.2022.

A report in the form of affidavit affirmed on 9th March, 2023, has been filed on behalf of the Board wherefrom it appears that the Board has prayed for 2 three weeks' time stating that the certificates would be prepared completely by three weeks from that 03.03.2023.

This three-week period is over on 24th March, 2023 but the TET certificates have not been given.

Therefore, I direct the President of the Board to appear personally before this court to explain why the job of granting TET certificates has not been completed till date.

The President of the Board should appear personally tomorrow at 10:30 a.m. before this court to explain the situation, when this matter will appear under the heading 'To be mentioned'.

The report filed today before this court is kept on record.
