The petitioner is an accused in a case registered under Section 414 of the Indian Penal Code and Section 25(1-b)a and 26 of the Arms Act.
The petitioner has been prosecuted for having been found in possession of pistol 7.65 attached with magazine having four cartridges. Besides above, 16 more cartridges of 7.65 and some golden ornaments have also been recovered.
It is submitted that the petitioner has been languishing in jail custody for more than one year. Charges have been framed on 16th January, 2015, but till date no witness has turned up.
Counsel for the State has opposed the petitioner's prayer for bail and submitted that prayer for bail made on behalf of the petitioner has been rejected vide order dated 25th February, 2015 in B.A. No.9559 of 2014.
Considering period of detention of the petitioner in jail custody and slow progress of trial, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount, each, to the satisfaction of learned Chief Judicial Magistrate, Dhanbad, in connection with Rajganj P.S. Case No.56 of 2014, corresponding to G.R. No.3483 of 2014, -2- with conditions that one of the bailors must be local permanent resident, having landed property within the jurisdiction of the court below, and he shall furnish his identity card and details of property at the time of furnishing bail bond and the petitioner shall appear before the court below in person on each and every date falling within next four months.
The Trial Court shall take all efforts to get the trial concluded at the earliest.
