ORAL ORDER
2 07-08-2018Heard learned counsels for the petitioner and the State.
The petitioner, already in custody, seeks bail in connection with Kutumba P.S.Case No. 182 of 2017 registered under Sections 170, 171 and 212 of the Indian penal Code and 25(1-b)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that petitioner was not apprehended on the spot and there is no recovery of arms from his possession rather there is recovery of arms from one Arbind Ram and the petitioner was implicated in this case on the basis of disclosure of his name by Manish Kumar, as he has disclosed the names of persons who escaped away from that place and he has disclosed the name of Navin Paswan, whereas petitioner is Naresh Ram @ Naveen and the petitioner was made accused in one another case subsequent to present one and Patna High Court Cr.Misc. No.48045 of 2018(2) dt.07-08-2018 2/2 prior to that he has no criminal antecedent.
Having considered the aforesaid facts and circumstances, the petitioner, namely , Naresh Ram @ Naveen is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VII, Aurangabad in connection with Kutumba P.S. Case No. 182 of 2017.
