ORAL ORDER
5 20-02-2023These writ applications have been listed together on the request of learned counsel for the petitioners with consent of learned counsel for the State.
While hearing C.W.J.C. No. 17 of 2023 on 15.02.2023, this Court was informed that there are some more writ applications seeking adjudication on identical issues and those may be heard and disposed of in view of the order passed by this Court on 15.02.2023 in C.W.J.C. No. 17 of 2023.
These petitioners state that they have been appointed Patna High Court CWJC No.15978 of 2010(5) dt.20-02-2023 22/25 as Clerk during different years on compassionate ground in the different offices and departments of the Government of Bihar. It is their common case that they have been arbitrarily and illegally deprived of the pay scale of Rs. 4000-6000 and have been placed in the scale of Rs. 3050-4590 only because they have been appointed on compassionate ground.
In C.W.J.C.No. 17 of 2023, this Court has taken note of the judgment of the Hon'ble Division Bench of this Court passed on 23.06.2017 in L.P.A. No. 167 of 2016. The Hon'ble Division Bench has held that the appointees on the compassionate ground would also be entitled for the scale of Rs. 4000-6000.
This Court has further found that several writ applications some of whom have been referred by learned counsel for the petitioners such as CWJC No. 18449 of 2017, CWJC No.17151 of 2018, CWJC No.21926 of 2018, CWJC No.16761 of 2018, CWJC No.1948 of 2020, CWJC No.188 of 2021, CWJC No.11759 of 2021 and CWJC No.1548 of 2022 have been disposed of by this Court directing the competent authority to consider the cases of those petitioners who have been appointed on compassionate ground in the light of the judgment of the Hon'ble Division Bench and following those Patna High Court CWJC No.15978 of 2010(5) dt.20-02-2023 23/25 orders, the District Magistrates of some districts and the concerned departments have come out with the consequential orders.
The operative part of the order dated 15.02.2023 passed in C.W.J.C. No.17 of 2023 reads as under:-
"In the nature of the materials present, this Court is disposing of this writ application with a direction to the District Magistrate, Rohtas, Sasaram to consider the claims of the petitioners as well in the light of the decision of the Hon'ble Division Bench in L.P.A. No. 167 of 2016 and in the light of his own decision as contained in Annexure '12' to the writ application and pass an appropriate order thereon in consonance with his earlier decisions within a period of three months from the date of receipt/production of a copy of this order.
It goes without saying that upon examination of their claim if the petitioners are found entitled for the identical reliefs which have been granted to others, the consequential benefits shall follow. Before this Court parts with this order, the attention of the respondent nos. 2 and 3 who are the Principal Secretary, Revenue and Land Reforms Department, Government of Bihar, Patna and the District Magistrate, Rohtas respectively are drawn towards the Bihar Litigation Policy, 2011 wherein a mechanism has been provided to deal with the grievances of the employees whose cases would be covered by Patna High Court CWJC No.15978 of 2010(5) dt.20-02-2023 24/25 any order of this Court which has attained finality. This Court has been noticing that despite there being a litigation policy which was brought with an intention of reduce the litigation and pendency of the court cases, the department is not making sincere efforts to act in terms of the policy, as a result of this, several writ applications are being filed for identical reliefs. Learned counsel for the petitioners has informed today due to inaction on the part of different Collectorates and other offices he has filed at least ten more writ applications for identical reliefs which are still pending. He has undertaken to furnish the list of those cases tomorrow. The Principal Secretary(respondent no. 2) and the District Magistrate (respondent no.3) are, therefore, further directed to examine their records and take immediate steps to deal with the grievance petitions of the employees which are covered under the litigation policy of the State. In an appropriate matter, they may be called upon to furnish the action taken report. The order be communicated to the concerned respondents immediately.
This Writ Application stands disposed of. "
Today, learned counsel for the State were called upon by this Court to say as to whether there is any difference in the case of these petitioners with that of the petitioners in C.W.J.C. No. 17 of 2023. Learned counsel for the State do not dispute that all these writ applications are similarly situated with Patna High Court CWJC No.15978 of 2010(5) dt.20-02-2023 25/25 C.W.J.C. No. 17 of 2023 and that they would have no objection if these writ applications are also disposed of in similar terms.
In the aforesaid view of the matter, this Court directs the appointing authority of the concerned petitioner(s) to look into the grievance of the petitioners, examine the same in the light of the judgment of the Hon'ble Division Bench in L.P.A. No. 167 of 2016 and other cases decided by this Court as also taking note of the consequential orders which have been issued by the competent authority from time to time in respect of similarly situated persons and pass an appropriate order in respect of these petitioners within a period of three months from the date of receipt/production of a copy of this order.
These writ applications are disposed of accordingly.
