It shows that the respondent no. 1, as well as its Trademark-agent were served via email(s) on 22.09.2023. It further shows that though the respondent no. 1 remained unserved with speed-post, however its Trademark-agent was served with speed-post on 22.09.2023. In these circumstances, it is observed that the respondent no. 1 is duly served with the court notice.
The respondent no. 2 is a formal party.
The matter is already listed before the Hon'ble Court on 03.10.2023. Accordingly on the request of the counsel for the petitioner, be listed before the Hon'ble Court on 03.10.2023.
