Section 8(1) in Jammu and Kashmir Panchayati Raj Act, 1989
(1)Whenever a vacancy occurs by the death or resignation of panch or Sarpanch, the vacancy shall be filled by election or nomination as the case may be :Provided that the vacancy is for a period of more than six months.
