Section 15 in The M.P. Home Guards Act, 1947

15. Home Guard to be a public servant.

- A Home Guard acting in the discharge of his functions under this Act shall be deemed to be a public servant within the meaning of Section 21 of the Indian Penal Code, XLV of 1860.AnnexureForm of Certificate[See Section 6 (3) (a)]Name....................................Son of..................................Caste...................................Resident of.............................has been appointed an officer/a member of the Home Guards under Section 6 (3)(a) of the Central Provinces and Berar Home Guards Act, 1947 (XV of 1947). (i)The Provincial Government appointed 10th October, 1947 as the date on which the Act came into force in revenue districts of Balaghat, Durg and Hoshangabad. C.P. and Berar Gazette, dated 10-10-1947, Part I, at page 557.
(ii)The Provincial Government appointed 1st May, 1948 as the date on which the Act came into force in all revenue districts or parts thereof in the Province of C.P. and Berar in which it was not in force immediately before the said date. Notification No. 2557-1882-IV, dated 29-4-1948, published in C.P. And Berar Gazette, dated 30-4-1948, Part I at page 218.
(iii)The State Government appointed 1st of October, 1961, as the date on which the a said Act came into force in all other revenue districts or parts in which it was not in force before the appointed date. Notification No. 564-II-HG, dated 6-9-1961, published in M.P. Rajpatra, dated 22-9-1961, Part I at page 1560.
(iv)The Provincial Government have constituted the Home Guards raised under sub-section (1) of Section 3 into two courses; (1) Nagar Sena (Urban Home Guards) and (2) Gram Sena (Rural Guards). Notification No. 2930-2229-IV, dated 15-5-1948, published in C.P. and Berar Gazette, dated 21-5-1948, Part I at page 272.
