05.   20.08.2020             In view of extraordinary situation arose out of COVID-19,
                   the matter is taken up through Video Conferencing.
                             Learned counsel for the State submits that Case Diary of
                   the case has not yet been received.
                             Despite several opportunities granted to the counsel for
                   the State for obtaining the Case Diary in the matter, the State has
                   failed to produce the Case Diary.      This Court find it difficult to
                   dispose of the matter due to delay in obtaining the Case Diary.
                             This Court deem it appropriate to bring this matter to the
                   notice of the Office of the Advocate General so as to explore the
                   feasibility of having a meeting with the concerned stake holders
                   including the Home Secretary, DGP, Director Public Prosecution
                   and SPs of all districts, in order to streamline the procedure for
                   obtaining the Case Diary swiftly in the cases listed before this
                   Court. It is further suggested that the prosecution agencies can
                   explore the use of electronic mode of receiving such Case Diary
                   and other related documents.      This effort will go a long way in
                   arresting the problem of judicial delay in disposing of cases.
                             It is often experienced that because of the unavailability
                   of the Case Diary, the cases are unnecessarily getting adjourned
                   leading to wastage of precious time of the Court.

           Adverting to the instant case, due to repetitive request
made by the learned counsel for the State, a last chance is
given to the counsel for the State to obtain the Case Diary within
seven days from today. In the meantime, learned counsel for the
petitioner is also directed to file the copy of the F.I.R.
           It is made clear that if the Case Diary is not obtained in
the next date of listing, this Court will be constrained to proceed
with the matter without the Case Diary.
           The matter be listed in the next sitting of the next week.
           As Lock-down period is continuing for COVID-19, learned
counsel for the petitioner may utilize the soft copy of this order
available in the High Court's website or print out thereof at par with
certified copies in the manner prescribed, vide Court's Notice
No.4587 dated 25.3.2020.
           Free copy of this order be given to the learned counsel
for the State for compliance.
