Heard learned counsel for the petitioner as well as learned Standing Counsel for the respondents.
In compliance with the order passed by this Court, the District Programme Officer, Mr. Manoj Kumar Maurya, is present before this Court.
Learned Standing Counsel, on the basis of written instructions, submits that the petitioner?s case had earlier been considered and rejected in accordance with the prevailing policy at that time. Subsequently, a new government policy has been introduced vide Government Order dated 21.03.2023. Pursuant to the said policy, the petitioner applied for the post and participated in the selection process. However, she did not possess the requisite educational qualification, and therefore, her candidature cannot be considered.
It has further been submitted that the petitioner had earlier filed Writ Petition No. 4137 of 2012 (S/S), titled Arti Devi vs. State of U.P., which was disposed of by this Court vide order dated 07.08.2012. In compliance with that order, the petitioner?s case was duly considered and rejected. The petitioner was aware that her candidature for the post of Anganwari Worker had already been rejected under the earlier policy. Under the new policy now in operation, the minimum educational qualification required is Intermediate. Admittedly, the petitioner does not possess the requisite qualification, and thus, her case cannot be considered for the said post.
Learned Standing Counsel further submits that the post in question, which was previously reserved for promotion, has since been re-notified to be filled through direct recruitment. Accordingly, an advertisement was issued inviting applications for direct recruitment. The petitioner applied pursuant to the said advertisement. In the selection process, the selected candidate, Ms. Kusum Lata, secured 14.3 marks, whereas the petitioner obtained only 6.2 marks.
On due consideration of the fact that the selected candidate, Ms. Kusum Lata, secured higher marks on the basis of merit and was therefore selected for the post of Anganwari Worker, this writ petition lacks merit and is accordingly dismissed.
