COMMON ORDER
The Tamil Nadu Electricity Board has filed these writ petitions as against the orders passed by the 1st respondent/Authority under the Tamil Nadu Industrial Establishment (Conferment of Permanent Status to Workmen) Act, 1981.

The main contention of the learned counsel appearing for the petitioner is that the 1st respondent/Authority under the Tamil Nadu Industrial Establishment (Conferment of Permanent Status to Workmen) Act, 1981, have no jurisdiction to entertain the applications filed by the contract employees, seeking conferment of permanent status.
3. Admittedly, the private respondents have been engaged through contract for certain miscellaneous works. Similarly placed contract workers have also filed similar applications before the 1st respondent and the same were rejected or allowed by the 1st respondent/Authority and several writ petitions and writ appeals have been filed on the very same issue before this Court.

This Court had an occasion to decide a similar issue and held that the 1st respondent/Authority under the Tamil Nadu Industrial Establishment (Conferment of Permanent Status to Workmen) Act, 1981, cannot entertain the applications from the contract workers. This Court, while rejecting the claim of the private respondents, had granted liberty to the contract workers to workout their remedy by raising a dispute either under Section 2(k) of the Industrial Disputes Act, 1947 or under the Contract Labour (Regulation and Abolition) Act, 1970 before the Industrial Tribunal.
5. A Coordinate Bench of this Court, in batch of writ petitions, by following the Judgment of the Hon'ble Supreme Court in Steel Authority of India Ltd., & others Vs. National Union Water Front Workers and others, reported in 2001 (7) SCC 1, held that the authority under the CPS Act would not have any jurisdiction whatsoever to entertain a claim seeking conferment of permanent status from the contract labourers.
6. In view of the same, these writ petitions are allowed and the impugned orders are set aside.
