Heard the learned Counsel appearing on behalf of the petitioners and the State.
Petitioner Nos.2 and 4 are the married sisters-in-law of the victim housewife. Petitioner Nos.1 and 3 are their husbands respectively. It is submitted that they resided separately from the matrimonial home of the victim housewife and did not play any role in her matrimonial life.
Learned Advocate appearing for the State produces the Case Diary and opposes the prayer for bail. 2 Having considered the materials in the Case Diary and keeping in mind the extent of complicity of the petitioners in the alleged crime and the fact that they resided separately from the victim housewife during her life time, we are of the opinion that custodial interrogation of the petitioners may not be necessary and they may be granted anticipatory bail.
Accordingly, we direct that in the event of arrest the petitioners, namely, Sonu Singh, Ritu Prasad @ Ritu Singh, Mahesh Kumar Singh @ Mahesh Kr. Singh and Anju Prasad @ Anju Singh shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
