CENTRAL INFORMATION COMMISSION
Room No. 308, B-Wing, August Kranti Bhawan, Bhikaji Cama Place, New Delhi-110066
File No.CIC/SM/A/2009/001081/LS
Appellant : Shri Hari Shankar Singh
Public Authority : Ordnance Factory, Kanpur
(through Shri N.H.S. Ahmed, Addl GM
(CPIO))
Date of Hearing : 9.11.2009
Date of Decision : 9.11.2009
FACTS :
The matter, in short, is that the appellant had requested the competent authority to allow him to mutually exchange his residential quarter with another employee of the factory. The competent authority did not permit it in the light of the prevailing rules.
2. Aggrieved with the decision of the competent authority, the appellant has filed the present appeal.
3. Heard on 9.11.2009. Appellant present. The public authority is represented by the officer named above. It is the say of Shri Ahmed that mutual exchange was not permitted in the light of SRO 149 of 23.9.2009. On the other hand, the appellant would submit that the CPIO has misinterpreted the rules and thereby caused financial determent to him. He would also submit that he had requested for a copy of the prevailing rules but it was not provided to him. To this, Shri Ahmed would respond that he has no objection to providing the copy of the SRO 149 to the appellant.
DECISION
4. I would refrain from commenting on the merits of the appeal. Suffice to say that the CPIO is now willing to provide a copy of SRO 149 to the appellant and this should be done in 02 weeks time.
5. The matter is decided accordingly.
