Tribunal vide order dated 19.09.2017 cis well as 12.04.2012. The said order has been upheld by | the. Hon'ble Gauhati High. Court by "judgment and oder dated 25.04.2003 in WPIC} No. 2955/2003 as. well, os 'Hon'ble: Supreme Court by: 29 Judgment and order dated Vy 7.07 7.2013 in Civ Appeal No.646/2008. Pursuant hereto, the Union of» India represented by the Min risty of Communication & IT, Department of Posts vide F.Nod- 23/2000-P AP dated 01s March, 2016 have implemented the order dated 12.04.2002 in | respect of the app! cans in OA No.381/2000. 'counsel further 'submitted that the applicants have filed representations on various dates ie i.e 02.07.2018 and 30.08.2018 series) seeking permiss sion to drow 20% HRA of 6m ; CPC at the rate of 'B' Class city put no avail. According fo | the leamed counsel, 'the said: bebetis have not been ole granted to the applicants as hey were not the applicants in : 0. A.No.381/2000.

6. Learned counsel submitted that one similarly. situated er mployee, namely Sri Sukha Ram Bishnol posted at Aizwal filed O.A. 044/00089 /2017 claiming HRA at the rate of :
'BY class. cifles. This Tribunal | vide order dated 08.03.2017, | | dracted the respondents that in case the applicants are simi larly situated with th ie applicants in ©. A. No.381 of 2000, similar benefils be granted to the applicants therein. If was also directed that if ihe f pepe is not similarly situated, then the respondents wil | pass a speaking order pointing out as to why the case | is different from O.A.NOo. 381 /2000 after giving opportunity of being heard fo the 'appl canis. The exercise shall be comp Isted as expeditiously as possible, buf not later than four months from the date of receipt of this order.

Learned counsel further sulmitted that the similarly sittuaied employees were granted the payment of HRA @ 'B' class City of the basic pay in compliance of the orders ~ passed by this Hon'ble High Court as wellas by the Hon'ble Supreme Court over the same subject matier but the said 34 benefit has noi been exiended to the present applicanis. More SO, when the said jucdgmer nis have attained finality and as such, the present app ficants are also entitled the | benefit of the HRA @ 'B' class city.
8. _ Learned counsel further submitted thal the applicants are squarely covered 'by the order dajed - 12.04.2002 in O.A.No.381/2000 and upheld by the Hon'ble : Gauhati High Court by judgment and order dated 25 04,2003 in WP(C) No. 2955/2003 as well by the Hon'ble Supreme Court by judgment and order dated 17.07.2013 in Civil Appeal No. 46/2 1005 and as such, the applicants are also entitled to the benefit of HRA DBE Class cHy 20% or 16% : as the case may be) from ine dot ie of tt their actuci post ing at Aigwal, Mizoram with arrear ronetaly benefit.
9. Learned counsel further submitted that rnany other Centra Govemment employees: who are posted at. . Mizoram, Aizaw! are getting the HRA @ @ 'B class cy of the. basic pay and as such the applicants bathg the employees 32 'of the Central Government are also eniifled fo get the | same benefits of HRA @ @ "Bc class cily ie 20% or 16% of the | basic pay like that of the other Centr al Government employees during 1h 18 period they are posted in the Alzawl, | State of Mizoram.
