Learned advocate appearing for the petitioner submits that the petitioner is in custody for 709 days and till date there has been hardly any progress in the case, as such, petitioner may be released on bail.
Learned advocate for the de facto complainant opposes the prayer for bail as the examination of the victim is not yet over.
Learned advocate for the State has drawn the attention of the Court to the statement of the victim.
I have taken into account the overall materials appearing particularly the statement of the victim under Section 164 of the Cr.P.C. and on an assessment of the period of detention, I am of the 2 view that further detention of the petitioner is unwarranted.
Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Sanju Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court under POCSO Act-cum-learned Additional District and Sessions Judge, 1st Court, Barrackpore, North 24 Parganas. If on bail the petitioner shall be physically present on each and every date fixed by learned trial court and shall not leave the jurisdiction of the district of North 24 Parganas without the prior permission of the learned special court.
Accordingly, CRM(M) 2218 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
