ORDER
1. The grievance raised in this Original Application filed under Sections 14 and 15 read with 18 of National Green Tribunal Act, 2010 is alleged illegal operation of stone crushers/mining units without proper, valid licenses and permissions from concerned Regulators and running of these units in abadi area. The alleged violators have been impleaded as respondents 14 to 45. Tribunal thought it appropriate to obtain a factual report by order dated 24.05.2023 for which it constituted a Joint Committee comprising District Collector, Rewa, Central Pollution Control Board and MP State Pollution Control Board. Joint Committee has submitted its report in June 2023, after making inspection of the site on 21.06.2023. It is stated that air quality level is very bad. Value of PM10 in village Baijnath is exceeding limits. On the various complaints and the 1 manner of destruction of environment by stone crushers, Joint Committee Report has said as under:
S. Issues raised in the Response of the Joint No. Application Committee 1 Related to Air Pollution: District collector has constituted That the stone crusher units Task Force committee dated are running without any air 26.05.2023 copy enclosed pollution safety and protection Annexure-V for initiating action against the violator of the stone to control air pollution crushers and mines. The Task Force Committee has seized 10 stone crusher, due to non availability of any APCDs, and 21 stone crushers temporarily prohibited the operation. Due to lack of required Permission /NOC.
Task force joint inspection report is enclosed as Annexure-VI Joint inspection committee carried out Ambient air Quality Monitoring (AAQM) at 04 location on 21.06.2023.
2 Related to Water Body No water pollution was observed.
Pollution and Damages The water used by crusher is Water sources created through mainly for suppressing dust earlier mining have also been emission control. Source of water is emptied by these Mines and only bore well no other source of Stone Crusher Units for further water in this area. extracting Stones due to which, readily available water for cultivation and other purposes also been wasted.
3 Related to Illegal Blasting During inspection no local villagers Explosives are being used as well as applicant not pointed illegally without any check and out any place or particulars mines measures causing not only Air regarding illegal blasting. The joint Pollution but also hazardous to committee advise that No blasting the human life. is to be allowed of small mines because they could not follow blasting provision.
4 Related to Health issue to Such kind of health related issue abadi especially kids of were not confirmed by SDM Huzur tender age District Rewa and nearby village.
However medical check-up camp can be organized by District Administration.
5 Related to Damages Ancient No such damage was observed by Temple and Structure Units committee and petitioner has also are destroying the Aged not verified the location of Ancient Temples and Structure existing Temple.
in the local area 6 Related to Non-Development It was found that no mine owner is of Green Belt serious regarding plantation poor plantation was observed at mine area and around crusher units, no thick green belt developed to mitigate air pollution.
7 Related to No share in The Environmental compensation 2 revenue which could be used imposed and recovered earlier by for restoration and MPPCB and DMFT of state restitution of Eco-system government may be utilized for restoration and restitution.
2. Further, with regard to 32 stone crushers i.e., respondents 14 to 45, Joint committee report states that 1 stone crusher i.e., M/s. Sadguru Stone Crusher (respondent 15) has already been dismantled and found non-existing since long time. Remaining 31 crushers are in different villages in as much as, one in Sonar, two in Narora, two in Madhepur, six in Khamariya, six in Hinoti and fifteen in village Baijnath.

It is also evident from the report that Consent to Establish (hereinafter referred to as 'CTE') and Consent to Operate (hereinafter referred to as 'CTO') were not obtained by all the stone crushers. In many cases, CTO has already expired. District Administration had imposed penalty of Rs. 86,65,175/- upon 31 stone crushers for illegal mining activities as communicated by Collector Office, (Mining) District Rewa vide letter dated 20.06.2023, details whereof, are placed on record as annexure-VIII at page 434 of the paper book. Details of CTE, valid consent, expired CTO, without CTO, dismantled and permanently closed, etc. are given in the form of chart which is being included as Appendix to this order.
4. Details of compensation are also given in para C and D which are as under:
"C. Environmental Compensation Penalty on non-compliance of the consent conditions and illegal activities The Environmental compensation is based on the EC policy framed by the CPCB in compliance of order 31.08.2018 in O.A. 593/2017.
The joint committee based on its understanding has amount to be imposed as penalty on non- compliance of the consent conditions/ show cause notices.3
The particulars defined under penalty formula are below for the area under concern i.e stone crushers, Huzur Distt: Rewa EC = Pi x N x R x S x Lf Pollution Index for crushers : 50@ N= Number of Days Non-compliance period : The first day when consent was invalid to the last updated status on compliance R (Rupees) : Rs. 250 S (Scale of Operation) : Factor for scale of operation : 0.5 Varied based on the consented capacity@ (@ Scale of operation of stone crusher was taken as defined in CPCB) comprehensive Industry Document Series COINDS/78/2007-08 on Stone Crusher (Feb 2009) Small scale : 3-25 TPH (factor for scale of operation is : 0.5) Medium Scale : 25-100 TPH (factor for scale of operation is : 1.0) Large scale : 100 TPH (factor for scale of operation is : 1.5) The daily hours of operation of a stone crusher were taken = 10 hrs Total Days of operation in a year were taken = 225 days@ 19 days per month (Note : The days of non-compliance were calculated based on maximum 225 operational days in a year) LF (Location Factor): 1.0 (based on the population of the city/town as per the census of India falls under less than 1 Million population) Nearby city Rewa population is 2.37 lakhs (2011 census) Table No: 2. 2. In compliance of the directions passed by the Hon'ble tribunal, "Those stone crushers which are closed may not be allowed to open without remedial measures, including accountability for the past violations and compliance of Environmental norms"
3. Stone crusher operation shall be only permitted in case they have rented owned mine.
74. Plantation requires collected effort from all of the stone crusher as contribution for plantation by the forest department.
5. Water sprinkler are required to function on road frequently twice in a day by contribution of the stone crusher to the local panchyat.
6. M/s. Ultra Tech Cement. Bela is a major stake holder in this area. They have cement plant as well as major mining of lime stone which causes major transportation of trucks, and dumpers in these area on the road, therefore, M/s. Ultra Tech have to provide water sprinkler trucks to the approach road twice a day.
7. Mining department should issue permit pit pass as per the production capacity granted in the consent."
5. Violation on the part of respondents-stone crushers are evident.
However, before taking any further action, we find it appropriate to issue notice to them. We direct Registry to issue notices to respondents 14 to 45, permitting them to file their response to the averments made in the OA as also to the Report filed by Joint Committee and to place other relevant facts before this Tribunal in their defense, within 3 weeks.
6. Response shall also be filed by respondent 5 giving details of the status with regard to consent to respondents 14 to 45 and other relevant facts by the next date of listing.
7. Respondents 1 to 3 are also issued notices and they may also file reply, if any, by the next date of hearing.
