3. The five petitioners, being Staff Nurses of the respondents BSF, have filed this petition claiming, inter-alia, parity in the pay scale of Staff Nurses in respondents BSF with their counterparts in Central Reserve Police Force (CRPF) and Central Health Services.

4. The counsel for the respondents BSF, appearing on advance notice, states that notice preceding the petition was given to BSF, instead of to the Ministry of Home Affairs (MHA). It is stated that this petition be disposed W.P.(C) 10290/2020 Page 1 of 2 of directing the same to be treated as a representation and further directing the MHA to consider the demand of the petitioners.

5. The counsel for the petitioner has drawn attention to Annexure P-9 of the petition, being the judgment of this Court in Sunil Kumar Vs. UOI MANU/DE/2756/2015 (DB), and contends that relief with respect to the Staff Nurses of CRPF and Indo Tibetan Border Police Force (ITBP) has already been granted by this Court.

6. Issue notice.

7. Notice is accepted by the counsel for the respondents BSF.

8. Counter affidavit, if any, be filed within six weeks. Rejoinder, if any, be filed within further two weeks thereafter.
