158 Part measuring 4.99.0 Hectares, Vembankudi village, Sivagangai Taluk ad
District, within a time frame that may be stipulated by this Court.

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents to issue dispatch transport slips for transporting gravel sand and to permit the petitioner to commence again the quarrying operations in the subject property in Survey No.158 Part, measuring 4.99.0 Hectares, Vembankudi village, Sivagangai Taluk ad District.
2. The contention of the petitioner is that he has already been granted permission to carry out quarrying operations and holds a valid licence. However, the respondents have not issued the necessary transport and transit pass. Therefore, the petitioner is not able to transport the gravel sand.
3. The learned Government Advocate, on instructions, submitted that a writ petition filed in the nature of a Public Interest Litigation (PIL) is pending before this Court, wherein the prayer is to take action against violations in quarry operations.
4. The learned Counsel appearing for the petitioner submitted that based on 2/4 https://www.mhc.tn.gov.in/judis ( Uploaded on: 26/06/2025 06:51:50 pm ) W.P(MD)No.17061 of 2025 the interim direction, a spot inspection and enquiry were already conducted and there is no adverse report against the petitioner. In such circumstances, the respondents cannot withhold the issuance of transport and transit pass.
5. In view of the above, the third respondent is directed to issue the necessary transport / transit pass to the petitioner, within a period of five (5) days from the date of receipt of a copy of this order.
6. With the above said direction, this Writ Petition is disposed of. There shall be no order as to costs.
