- Sections 2 (1)(g), 23 - Contract Act , 1872 - Housing - Booking of flat - Delay in service - Appellants did not give any valid reasons as to why they transferred property to third party, despite their contractual obligation to respondents (complainants) - Obligation was on appellants to show that he was unable to transfer property to respondent - Person cannot be made to wait indefinitely for possession of flats allotted to them - They are entitled to seek refund of amount paid by them, along with compensation - When there was no delivery period stipulated in agreement, reasonable time has to be taken into consideration - Time period of 3 years would have been reasonable for completion of contract - Until now there was in 4 redevelopment of property - Deficiency of service on part of appellants Proved.

- Purchase of flat - Complainant denied having owned any other flat except two flats situated at separate places having three rooms in all - She has three daughters - It was argued that they desire a bigger house to accommodate entire family at one place - Both complainants are consumers.

(ii) Consumer Protection Act, 1986 - Sections 2(1)(g), 2(1) (r), 14 (1) (d), 21 (a) (i) - Housing - Cancellation of allotment - Consideration deposited - Non-delivery of possession - Mala fide intention - Ulterior motives - Deficiency in service - Unfair trade practice - OPs had already received a sum of Rs. 1,02,13,803 out of total consideration of Rs. 1,04,75,694 - OPs also demanded additional sum of Rs. 3,96,000 towards car parking - After receiving almost the entire amount OPs chose to cancel the same without giving delivery of possession - Complainants were not bound to pay the double amount for car parking - Complainant should have been warned and notice should have been sent before cancelling the flat - This shows the arbitrary, high-handedness, arrogance, despotic and capricious character - OP2 directed to pay sum of Rs. 1,02,13,803 with interest @ 18 % p.a. from date of its deposit till its realization - Compensation @ Rs. 1 lakh awarded.

Sections 2(1)(g), 21(a)(ii) - Housing - Purchase of semi- finished flat - Agreement executed for completion of construction work - Non-delivery of possession - Default in payment - Deficiency in service - Possession or refund claimed

- State Commission allowed complaint - Hence appeal No letter sent by opposite party to complainant stating therein that construction of flat was complete - As per Clause 16 of agreement, in case of breach or violation of its obligation by builder, complainant was entitled to amount along with interest @ 18 % p.a. - As complainant defaulted in payment, direction issued to pay penal interest 3 % per month on delayed payment

- Opposite party is entitled to deduct interest so calculated from amount which it is required to refund to complainant.
