ORAL ORDER
Petitioners are seeking a writ of mandamus directing the Corporation to assign the ranking of the petitioners in accordance with the select list, and not on the basis of the ranking assigned in the probationary list by effecting necessary correction in the provisional seniority list dated 18.03.2019 at Annexure - M and sought a direction to extend the benefit of past service, seniority, promotion and all other consequential monetary benefits as requested by the petitioners in the written representation dated 20.08.2019 at Annexure-N by strictly the following guidelines as stipulated in the Circular dated 16.09.1993 at Annexure-H.
2. Petitioners were working as the conductors in BMTC and belong to scheduled caste and scheduled tribes. The respondent-Corporation issued a Notification No.1/92 on 04.01.1992 for recruitment to the post of drivers and conductors i.e., 723 posts of drivers and 553 posts of

NC: 2024:KHC:36885 WP No. 43168 of 2019 conductors in North and South division of BTS, the petitioners applied for the post of conductors pursuant to the recruitment notification, at the time of the notification issued by the respondent, the State Government imposed a ban on direct recruitment, as a result, direct recruitment did not take place and the select list for the said post pursuant to the Notification No.1/92 was not published. The respondent, in order to operate schedules without any interruption and to provide transport facilities to the traveling commuters, made temporary arrangement by engaging services of local candidates belonging to the Scheduled castes and Scheduled Tribes, among the candidates who had applied to the post of conductors in terms of the Notification No.1/92 and accordingly, the respondent-Corporation issued an order of appointment to the local candidates referred to in the Notification No.1/92 to work as conductors temporarily for a specific period, subject to extension from time to time with the basic pay along with other allowances fixed for the post of conductor as specified in the Notification.

3. The tenure of the appointment as a local candidate to the petitioners did not confer any right to continue in service of the corporation or seek for appointment to such posts or to any other posts in the Corporation and the temporary appointment orders were issued to as many as 82 local candidates as drivers and conductors, who belonged to the Scheduled Castes and Scheduled Tribes on temporary basis with effect from 05.03.1992. In August 1992, the respondent-corporation decided to discontinue the services of all the candidates who were appointed temporarily for a specific period. The petitioners questioned the decision of the respondent- Corporation in W.P.No.25519/1992 and connected cases and sought declaration to declare that they are regularly recruited drivers and conductors as per the Karnataka State Transport Corporation (Cadre and Recruitment) Regulation, 1982 and direct the Corporation to regularize the services of the petitioners. This Court, vide order dated 22.02.1993, passed the following order:

NC: 2024:KHC:36885 WP No. 43168 of 2019 "7. Some petitioner have been selected through the Employment Exchange and some others have been appointed and continued in service from time to time, either by the Corporation itself or under the interim orders of this Court.
In respect of such employees until permanent arrangements are made or if the temporary exigency which had arisen has already ceased to exist, shall not be disturbed.
8. In case any of the petitioners who have made applications pursuant to the advertisements referred to above calling for applications for appointment in the Corporation have been selected but not appointed for various reasons and are now age barred, due weightage to the same shall be given in future appointments to be made by the Corporation. Such weightage shall be the deduction of the period that has lapsed between the recruitment attempted to be made and abandoned and fresh recruitment to be made.
9. These writ petitions shall stand disposed of accordingly."
4. Pursuant to the order passed in the above mentioned writ petitions, the services of 401 candidates

NC: 2024:KHC:36885 WP No. 43168 of 2019 including the petitioners were discontinued vide order dated 10.04.1993. The petitioners and the similarly situated candidates approached the State Government seeking relief to make provision for their appointment by invoking the provisions of Road Transport Corporation Act, 1950, the State Government issued an order on 14.05.1993 directing to reinstate the temporary employees who belonged to Scheduled Castes and Schedule Tribes and a report to this effect was directed to be submitted to the State Government.
5. Pursuant to the order dated 14.05.1993, the Corporation framed guidelines to reinstate all 882 candidates (conductors and driver) belonging to the Scheduled Castes and Scheduled Tribes. The respondent- Corporation appointed the candidates for the post of conductors and placed them on probation from the date of reporting to duty in terms of the order dated 04.11.1995. As per the guidelines issued by the Corporation, the petitioners were placed as badli conductors in the

NC: 2024:KHC:36885 WP No. 43168 of 2019 respondent-Corporation until their services were regularized in proportion with the vacancies arising from time to time and hence, the petitioners who were selected by virtue of the Government order dated 14.05.1993 were placed below the selected candidates published in the select list for the post of conductors.
6. The contention of the petitioner is that the provisional list of the conductors dated 18.03.2019 at Annexure-M, the candidates at Sl.Nos.219 to 744 are selected candidates in respect of the recruitment Notification No.1/92 in the year 1992, whereas, Sl. Nos.745 to 902 are the candidates appointed pursuant to the Government order dated 14.05.1993. That, while assigning the ranking and placing the petitioners on probation, the petitioners herein, who were working against the existing sanctioned vacancy, the petitioners have to be placed on probation immediately after reinstatement and the circular at Annexure - M and have not been followed by the respondent - Corporation.

7. It is relevant to note that the petitioners are appointed pursuant to the Government order dated 14.05.1993 and were placed below the selected candidates under Notification No.1/92 and the probationary dates of these candidates was revised vide order dated 28.06.2019 by a final selection list.

Learned counsel for the respondent has filed a memo along with the final seniority list of the conductors dated 28.06.2019, which is in compliance with the judgment of the Apex Court in the case of B.K. Pavithra and others Vs. Union of India Case-II1 and in terms of the guidelines issued by the Apex Court and also the State Government, the provisional seniority list from 27.04.1978 to 15.05.2019 was prepared for the post of conductor and the same was published by the Corporation on 29.05.2019 calling for the objections to be filed within seven days. 1 AIR 2019 SC 2723

The petitioners have not filed objections to the provisional seniority list, the Corporation considered the objections filed by the other employees within the stipulated period and published the final seniority list of the conductor dated 28.06.2019. List was redone pursuant to the order passed by the Apex Court in the case of B.K. Pavithra Case -II and the names of the petitioners who were appointed pursuant to the directions of the State Government dated 16.09.1993 was found in the place in the seniority list dated 28.06.2019.
10. The select list of the Corporation is in terms of the decision taken by the Board to the order of the Government dated 14.05.1993, the relevant portion of the resolution at Annexure-H reads as under:

The petitioners were issued with the provisional seniority list dated 18.03.2019 and the final seniority list on 28.06.2019, the petitioners have accepted the provisional and the seniority list and did not file objections to the provisional list, whereby, the final seniority list was published and the seniority list dated 28.06.2019 has not been challenged by the petitioners. The petitioners do not have the benefits available to the regular candidates appointed in terms of the Notification No.1/92 and the

Accordingly, this Court pass the following:
ORDER Writ petition is dismissed as devoid of merit.
