Earlier the respondent-workman approached this Court with the grievance that he has been reinstated and serving the petitioner Institution, at least is entitled to be paid minimum wages in terms of the notification issued by the Government of India and this Court taking note of the submissions made decided the application vide order dt.24.10.2008 directing the petitioner to pay minimum wages prevailing on the date of passing of the order.
However, present application has been filed by the respondent with the grievance that despite minimum wages being revised @ Rs.149/- per day w.e.f.01.04.2010 still the revision of minimum wages has not been given effect to.
Counsel for respondent-workman submits that once order has been passed by the Court to pay minimum wages, the petitioner is under an obligation at least to pay the minimum wages revised in terms of the notification issued by the Government of India from time to time.
This Court also finds substance in the submission made that once order has been passed by the Court on 24.10.2008, the petitioner is under obligation at least to pay the minimum wages to the respondent-workman taking note of the revision of minimum wages as and when took place.
Accordingly, the present application is allowed. The petitioner is directed to pay minimum wages to the respondent-workman at the rate of Rs.149/- per day w.e.f.01.04.2010 and shall also continue to pay the minimum wages revised from time to time till further orders and the arrears pursuant to Rs.149/- per day w.e.f. 01.04.2010 (supra) after being computed may also be paid to the respondent-workman within two months.
Accordingly, the application stands disposed of.
