श्री नीतीश कुमार : वे न केवल तथ्य से परे है, बल्कि भ्रामक है एवम् रेलवे अधनियम १९८९ की धारा ११४ एवम् धारा ११५ की व्याख्या राजनीतिक दुर्भावना से ग्रसित होकर की गई है। उन्होंने कहा है कि "रेलवे अधनियम १९८९ की धारा ११४ के अंतर्गत रेलवे संरक्षा आयोग द्वारा न ही वैधानिक जांच की गई और न ही धारा ११५ के अंतर्गत विभागीय जांच हुई।"
महोदय, रेलवे अधनियम १९८९ की धारा ११४ में उल्लिखित है क "Inquiry by Commissioner: (I) On the receipt of a notice under section 113 of the occurrence of an accident to a train carrying passengers resulting in loss of human life or grievous hurt causing total or partial disablement of permanent nature to a passenger or serious damage to railway property, the Commissioner shall, as soon as may be, notify the railway administration in whose jurisdiction the accident occurred of his intention to hold an inquiry into the causes that led to the accident and shall at the same time fix and communicate the date, time, place of inquiry:
Provided that it shall be open to the Commissioner to hold an inquiry into any other accident which, in his opinion, requires the holding of such an inquiry. SPEAKER: Shri Nitish Kumar, please restrict yourself to your statement. श्री नीतीश कुमार : उपरोक्त से स्पष्ट है कि रेल संरक्षा आयुक्त दुर्घटना के उपरांत जांच करने के लिए प्राधिकृत हैं। पैरा २ में यह भी उल्लिखित है कि यदि रेल संरक्षा आयुक्त जांच कराने में किन्हीं कारणों से सक्षम नहीं है, तो इसकी सूचना रेल प्रशासन को देंगे। इस संदर्भ में यह कहना है कि जहां तक मुझे स्मरण है, स्मरण के आधार पर मैं यह पूरा वक्तव्य दे रहा है, क्योंकि हमारे पास एक्सेस नहीं है फाइल्स का। MR. श्री नीतीश कुमार : इस संदर्भ में यह कहना है कि जहां तक मुझे स्मरण है इस घटना की सूचना २७ फरवरी को ही नियमानुसार रेलवे प्रशासन ने संरक्षा आयुक्त, पश्चिम परिमंडल को दी थी। संरक्षा आयुक्त, पश्चिम परिमंडल ने बाद में मुख्य संरक्षा अधिकारी, चर्चगेट, मुम्बई को यह अवगत कराया था कि चूंकि गुजरात सरकार ने Commission of Inquiry Act 1952 के तहत जांच आयोग गठित किया है। इस कारण रेलवे अधनियम की धारा ११९ के अंतर्गत इस जांच को रेलवे संरक्षा आयोग नहीं कर सका है। रेलवे अधनियम के धारा ११९ में उल्लिखित है :
"No inquiry, investigation, etc. to be made if the Commission of Inquiry is appointed : Notwithstanding anything contained in the foregoing provisions of this Chapter, where a Commission of Inquiry is appointed under the Commissions of Inquiry Act, 1952 (3 of 1952), to inquire into an accident, any inquiry, investigation or other proceeding pending in relation to that accident shall not be proceeded with, and all records or other documents relating to such inquiry shall be forwarded to such authority as may be specified by the Central Government in this behalf."उपरोक्त से स्पष्ट है कि जब Commission of Inquiry Act के तहत कोई जांच आयोग बैठाया जाएगा, तो कोई और जांच उसी घटना के संबंध में नहीं की जा सकती है।
लालू प्रसादजी ने कहा है रेलवे अधनियम १९८९ की धारा ११५ के अन्तर्गत विभागीय जांच नहीं की गई। मैं रेलवे अधनियम १९८९ की धारा ११५ को उल्लिखित करना चाहूंगा।
"Inquiry by railways administration: Where no inquiry is held by the Commissioner under sub-section (1) of section 114 or where the Commissioner has informed the railway administration under sub-section (2) of that section that he is not able to hold an inquiry, the railways administration within whose jurisdiction the accident occurs, shall cause an inquiry to be made in accordance with the prescribed procedure. श्री नीतीश कुमार : अध्यक्ष महोदय, लालू प्रसाद जी ने मुझ पर एवं तत्कालीन रेल राज्य मंत्री पर यह आरोप लगाया है कि हम लोग घटना स्थल पर नहीं गए। जब इस घटना की सूचना मिली, मैं उस समय रेल भवन कार्यालय में बैठा था। मैंने तत्काल संबंधित रेलवे के अधिकारियों से सम्पर्क किया। उस समय प्राथमिकता थी :
( क) कोच में फंसे लोगों को सुरक्षित बाहर निकालने की (ख) उस ट्रेन में यात्रा कर रहे यात्रियों को सकुशल आगे गन्तव्य तक पहुंचाने की (ग) एवं इस घटना के मद्देनजर गुजरात तथा देश के अन्य भागों में सुरक्षित रेल परिचालन की जिससे रेल सम्पत्ति तथा रेल यात्रियों को नुकसान न हो। …( व्यवधान) MR. श्री नीतीश कुमार : लालू प्रसाद जी ने फॉरेंसिक साइंस लेबोरेटिरी, अहमदाबाद की रिपोर्ट दिनांक १७.५.२००२ का उल्लेख अपने भाषण में किया है जो कि सी.आर. नं. ९/ २००२ गोधरा रेलवे पुलिस स्टेशन से संबंधित है। फॉरेंसिक साइंस लेबोरेटिरी, अहमदाबाद की इस रिपोर्ट के आधार पर कार्रवाई इस घटना की जांच कर रहे विवेचना अधिकारी (Investigating Officer) को करनी है। इस संबंध में अतारांकित प्रश्न संख्या ३७८३ लोक सभा में किया गया था जिसका जवाब तत्कालीन रेल राज्य मंत्री द्वारा दिया गया था जिसे मैं उद्धृत कर रहा हूं। MR. FORENSIC REPORT ABOUT SABRMATI EXPRESS AT GODHRA 3783. Shri G.M. Banatwalla Shri Sushil Kumar Shinde Shri Jyotiraditya M. Scindia Will the Minister of Railways be pleased to state: Whether a team of Forensic Science Laboratory of Ahmedabad inquiring into the Godhra train carnage of February 27, 2002, has after a simulated experiment of the fire in Railways train coach No. S-6, came to the conclusion that the fire which took the life of 59 passengers including women and children, could be possible only if the inflammable like petrol was dowsed from inside the compartment and not is thrown from outside; If so, the result of the follow up investigations based on the said findings; and The action taken in this regard? ANSWER Minister of State in the Ministry of Railways (Shri Bandaru Dattatraya)

SHRI NITISH KUMAR : The cases of crime on Railways are reported to, registered and investigated by the Government Railway Police (GRP). However, information furnished by the Superintendent of Police, Vadodara indicates that the Forensic Science Laboratory, Ahmedabad has opined that the petrol could have been poured from inside the coach. Any follow-up action on the report has to be taken by the State Government. स्पष्ट है कि फॉरैन्सिक साइंस लैबोरेटरी की उपरोक्त रिपोर्ट के संबंध में रेल मंत्रालय ने इस सदन को अवगत करा दिया था। चर्चा के दौरान श्री कपिल सिब्बल ने कहा है कि "Sir this report is dated 17 May 2002 it means that almost three months after the tragedy took place this report was with the Government with the Railway Minister yet this was kept under wraps till 2004 …" मुझे यह पढ़कर श्री सिब्बल के कानून के ज्ञान पर बहुत अफसोस एवं आश्चर्य हुआ है। अफसोस इस बात का कि श्री सिब्बल सरीखे वकील को यह जानकारी नहीं है कि फॉरैन्सिक साइंस लैबोरेटरी की रिपोर्ट किसे दी गई थी तथा आश्चर्य इस बात पर कि फॉरैन्सिक साइंस लैबोरेटरी की रिपोर्ट रेल मंत्री के पास थी। ऐसा लगता है कि उनके अनुसार रेल मंत्री ही इस घटना के इनवैस्टिगेटिंग ऑफिसर थे जिसके पास फॉरैन्सिक साइंस लैबोरेटरी की रिपोर्ट आई थी। इसके अतरिक्त यह गलत है कि २००४ के पूर्व इसके संबंध में जानकारी इस सदन को नहीं दी गई थी। हमने उल्लेख कर दिया कि जानकारी सदन को दी थी। जैसा कि मैं पहले ही बता चुका हूँ कि एक अतारांकित प्रश्न के उत्तर में इस संबंध में सदन को अगस्त २००२ में ही अवगत कराया जा चुका था। श्री सिब्बल को इस तरह का भ्रामक वक्तव्य नहीं देना चाहिए। महोदय, यह भी उल्लेखनीय है कि मार्च २००३ में ही साबरमती एक्सप्रैस में गोधरा घटना के संबंध में इसी सदन में सवाल उठा था। इसके उत्तर में हमने सदन के पटल पर जवाब रखा था। जो भी उपलब्ध सूचना थी, उस पर इस सदन में सवाल उठा था। उसके उत्तर में मैंने इसी सदन के पटल पर सारी जानकारी जो मांगी गई थी, वह रख दी थी। उपरोक्त तथ्यों से स्पष्ट है कि श्री लालू प्रसाद ने मुझ पर जो आक्षेप किया है, वह राजनीति से प्रेरित है और इस प्रकार का आचरण संसदीय परंपराओं और मर्यादाओं के प्रतिकूल है। MR.
