2. 15.5.2009. This application has been filed for condoning the delay in filing the appeal.

For the reasons stated in the application, delay in filing the appeal is condoned.
Application stands allowed. Now, we have taken the appeal on merit. Learned counsel for the appellant very fairly submitted that similar appeals have already been dismissed by this Court as will be apparent from the order dated 12.1.2009 passed in L.P.A.No.1030 of 2008 and other analogous appeals.
In that view of the matter, following 2 the aforesaid order dated 12.1.2009, this appeal is also dismissed with the similar observations.
