By filing this petition under Sections 226 of the Constitution of India, the petitioner is aggrieved by the order dated 24.11.2016, Annexure P/1 passed by respondent No.2 by which he has been transferred from the office of Chief Medical & Health Officer, Guna to the office of Chief Medical and Health Officer, Dindori during the mid academic session and the impugned order has been passed during the ban period.
Counsel for the petitioner submits that no post is vacant at Dindori because one Ajit Jain is already working at Dindori. This aspect has also been raised in the representation filed by him before the competent authority which is at Annexure P/6 and prays that a direction may be issued to the respondents to decide the pending representation.
On the other hand, the learned counsel for the respondents has no objection if the representation is decided by way of speaking order.
In view of the above, the respondents are directed to decide the pending representation, Annexure P/6 considering the judgment passed by the Hon'ble Supreme Court with regard to mid-
2 W.P.8364/2016session transfer and circulars issued by the State Govt. from time to time in force and pass a speaking and reasoned order preferably within a period of four weeks from the date of receipt of certified copy of the order passed today. The petitioner shall be allowed to continue at Guna till the representation is decided. It is made clear that this Court has not expressed any opinion on the merits of case.
This petition stands disposed of finally.
