AVNEESH JHINGAN, JUDGE (ORAL) These two petitions were filed seeking anticipatory bail under Section 438 Cr.P.C. in case FIR No.382 dated 29.11.2019 under Sections 383, 384, 328, 420, 506, 34 IPC and Section 5 of the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 registered at Police Station Taraori, District Karnal.

The petitioners were granted interim bail in November 2020 subject to joining investigation. The matter is pending since then.

investigation but they have to undergo polygraphic test which could not be undertaken due to rush in the Forensic Lab.
Learned Senior counsel appearing for the petitioners submits that petitioners have no objection to undergo the polygraphic test, they will ensure their presence on the given date and time when they are called to undergo the polygraphic test.
Learned counsel for the complainant vehemently opposes the same.
In view of the statements made by learned counsel for the parties, these two petitions are disposed of. The interim orders are made absolute, subject to the condition that petitioners will continue to join investigation as and when called for and will remain present to undergo the polygraphic test as and when directed by the Investigating Agency.
The investigating agency will inform the petitioners three days in advance of fixing the date and time where the petitioners are required to undergo the polygraphic test.
In case of failure of petitioners to comply with conditions mentioned above, the State would be at liberty to file an application for re- calling of this order.
Disposed of accordingly.
