(1)Notwithstanding anything contained in the Drugs and Cosmetics Rules, 1945, any person having a valid licence to sell, stock, exhibit or offer for sale or distribute by retail or wholesale, may, supply invasive medical devices to be implanted through surgical intervention to a hospital for its patient against a delivery challan:Provided that in respect of supplies made against delivery challan of such medical devices, the licencee shall ensure that specified storage conditions are met.
