20 04-02-2013All matters are analogous raising common grievance and as such they have been listed together. The order is being passed in MJC No. 1428 of 2010.
Mr. Basant Kumar Choudhary, learned senior counsel, appearing on behalf of the petitioner and Mr. D.K.Sinha, Patna High Court MJC No.1428 of 2010 (20) dt.04-02-2013 16 /17 AAG-2 on behalf of the State are present.
There is agreement at Bar that petitioners of the present batch of contempt applications can be conveniently categorized in five categories. The first category would be the cases which were considered and rejected/allowed by the one man committee headed by Justice (Rtd.) Uday Sinha in the light of the order dated 11.02.2010 passed by a Division Bench of this Court in LPA No. 1623 of 2009 and analogous cases. The 2 nd category of the cases are where the writ appeal(s) preferred by the State have been accepted for consideration and order(s) of stay has been passed thereat. The 3rd category would be the cases in which writ appeal(s) preferred by the State and its officials are pending consideration but no stay has been granted therein. The 4th category of the case would be the cases where no appeal could be filed by the State against a common order passed by learned Single Judge. 5th category is necessitated on account of the fact that during pendency of the present batch of contempt application(s) the State/opposite parties passed an order of reinstatement of the petitioner of some of the present application(s) with certain conditions.
Mr. Sinha, learned AAG submits that he would hold consultation(s) with the counsel(s) of the petitioner(s) as also with Patna High Court MJC No.1428 of 2010 (20) dt.04-02-2013 17 /17 the State officials and will provide a list of those persons/petitioners who have, during pendency of the present contempt application(s), been favoured with order(s) of reinstatement with condition and the cases which can be placed in these categories.
Let it be recorded that Mr. Sinha has today taken a stand that the present batch of contempt application(s) may be considered after disposal of the LPA No. 200 of 2010 and analogous matters in which after concluding the hearing the judgment has been reserved on 18.09.2012. The said stand of the State shall be considered later.
Let the petitioners and the State complete the exercise of categorization of cases as indicated hereinabove as also the exercise which is required to be made in the light of the certain orders passed in favour of some of the petitioners during pendency of these application(s).
