1. This hearing has been done through hybrid mode.

2. The Petitioner is aggrieved by the non-honouring of the Petitioner's claim by the Respondent No. 1-Insurance Company- M/s. ICICI Prudential Life Insurance Company Limited. According to the Petitioner, insurance policy no. 20110707 was taken by her late husband Shri Keshav Mohan , from Respondent No.1, for covering the home loan (A/c no. 50669036 later converted into MOA Home Saver bearing A/s No. 52206053211) taken from the Respondent No. 2- Standard Chartered Bank. For paying the premium of the said policy, the Petitioner's late husband had further taken another loan (A/c no. 50680811) from the Respondent No. 2 Bank.

3. The first, second and third premium was paid by Respondent No.2 Bank to Respondent No.1 on time. However, there was late payment of the Signature Not Verified Digitally Signed By:RAHUL Signing Date:02.03.2023 13:00:37 fourth premium amount, which was refunded by Respondent No.1 to the Policyholder on 19th May 2020. Finally, the fourth premium was repaid to Respondent No. 1 by the policy holder on 17th June 2020.Further, additional premium payment was sought for the revival of the policy by Respondent No.1. However, finally, the policy was stated to be in a paid up state and the premium was also clearly stated to be paid up vide e-mail dated 24th September, 2020.

4. The Petitioner's husband who was an advocate passed away on 1st May, 2021 during the Covid-19 pandemic. The insurance claim has not been honoured by the Respondent. Only an amount of Rs.1,84,317/- is stated to have been paid.

5. Issue notice to both the Respondents.

6. Let affidavits be filed by the said Respondents dealing with the allegations in the writ petition.

7. List before the Registrar on 18th April, 2023.

8. List before the Court on 24th July, 2023.
