(1)The State Government may, after previous publication, make rules for carrying out the purposes of this Act.(2)In particular and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the matters which under any provision of this Act are required to be prescribed or to be provided for by rules.(3)All rules made under this Act shall be laid for not less than fourteen days before the State Legislature as soon as possible after they are made and shall be subject to such modification as the State Legislature may make during the session in which they are so laid. Any modification of the said rules made by the State Legislature shall be published in the Official Gazette, and shall, unless some later date is appointed by the State Government, come into force on the date of such publication.(4)[ Notwithstanding anything contained in sub-section (1), and sub-section (2), of this section or elsewhere in this Act, till such time as the State Government makes rules under this Act, the rules made under the Bengal Municipal Act, 1932 (Ben. Act XV of 1932) and in force immediately [before the commencement] [Inserted by West Bengal Act 30 of 1994, w.e.f. 13.7.1994.] of this Act, shall so far as they are not inconsistent with the provisions of this Act, be deemed to be the rules made under this Act, and the provisions of sub-section (3) shall not apply to any rules deemed under this sub-section to be the rules made under this Act.](5)[ Notwithstanding anything contained in sub-sections (1), (2) and (4) of this section, the State Government may, in special circumstances, for the reasons to be recorded in writing, for the interest of the public, relax any or all the provisions of a rule made under this Act.] [Inserted by section 17 of the W.B.
