ORDER
Hon'ble Mr. Tarun Shridhar, Member (A) The applicant no.1 is an All India Employees Provident Fund Staff Federation through its General Secretary and the rest of the applicants are various officers of the Employees Provident Fund Organization (EPFO) holding the post of either Enforcement Officer (EO) or Accounts Officer (AO). The post of EO/AO is a step towards induction into Group 'A' post in the EPFO. On the stated account of stagnation in different cadres and also on account of administrative propriety, the Central Board of Trustees (CBT) of the EPFO took a decision to undertake a review of the organization and cadre for the purpose of its restructuring. For this purpose, a Committee comprising officers at different levels was constituted and it submitted a report which was considered in a special meeting of CBT on 09.12.2015. After examining the contents of the report, the CBT appointed a Sub Committee to make appropriate recommendations to the Board, which after taking into consideration the recommendations, took a decision that the cadre restructuring as proposed should be implemented w.e.f. 09.12.2015, i.e. the date on which the Sub Committee was appointed.

2. The report of the Sub Committee, which recommended review and restructuring of the cadre, indicated detailed studies and thereafter determined the number of officers and staff required at various levels in terms of functional requirements and accordingly, made specific recommendations with respect to the number of posts in Group 'A' specifically Assistant Provident Fund Commissioner (APFC), Deputy Provident Fund Commissioner (DPFC) etc.. Although the report of the Sub Committee along with its recommendations were approved, certain anomalies were noticed, which were referred to an Anomaly Redressal - cum - Implementation Committee (ARCIC), which too submitted its own opinion/recommendation in the matter of redistributing certain posts and giving its own recommendation with respect to the number of posts of DPFC and APFC.
3. The cadre restructuring proposal was once again considered by the CBDT and thereafter submitted to the Ministry of Labour & Employment for its approval. The Ministry of Labour, vide its letter dated 27.12.2016, approved the proposal, however, subject to certain amendments. Pursuant to this approval, an Office Order dated 13.01.2017 containing the revised cadre strength 33 O.A. No. 3139/2022 was issued by the EPFO and thereafter necessary amendments in the rules were carried out and amended rules notified vide Notification dated 16.03.2018. The applicants herein place a challenge upon these three communications in the present Original Application, seeking the following reliefs:-
"a. Quash Annexure A/1 Letter No.A-
32022/10/2014-SS-1 dated 27.12.2016 issued by the Ministry of Labour & Employment to the extent it earmarked the revised sanctioned strength of RPFC-II as 299 and that of APFC as 452 as if it were 2 cadres instead of mentioning it as the revised sanctioned strength of APFC as 751.
b. Quash Annexure A/2 Office Order No.HRM-I/D- 1(1)2017/CR/26417 dated 13.01.2017 issued by the Central PF Commissioner to the extent it earmarked the revised sanctioned strength of RPFC-II as 299 and that of APFC as 452 as if it were 2 cadres instead of mentioning it as the revised sanctioned strength of APFC as 751.
c. Quash Annexure A/3 Recruitment (Amendment) Rules for RPFC-II vide Notification No.HRD/56/2016/RR/Commissioner's Cadre published dated 16.03.2018 issued by the Ministry of Labour & Employment, Govt. of India.
d. Direct the Respondents to implement the Cadre Restructuring with effect from 09.12.2015 as decided by 210th CBT meeting.
e. Direct the Respondents to prepare the up-to- date Seniority list of EO/AOs and to promote the 206 senior most AO/Eos tot eh post of APFC as on date of implementation of Cadre Restructuring. f. Direct the Respondents to notify the amended Recruitment Rules for the post of APFC incorporating the sanctioned strength of APFC as 751 in the Draft 34 O.A. No. 3139/2022 Recruitments Rules specifying that the total sanctioned strength of RPFC II/APFC would be 751 and 40% of the APFC (299 out of 751) having 4 years of service would be upgraded as RPFC II.
g. Direct the Respondents to freeze the process of Direct Recruitment in APFC Cadre till the amended Recruitment Rules for the post of APFC incorporating the sanctioned strength of APFC as 751 is notified. h. Direct the Respondents to freeze the process of Direct Recruitment in APFC Cadre till the issues raised through this application are adjudicated upon by this Hon'ble Tribunal.
i. Direct the Respondents for the strict compliance of roster in the combined strength of 751 APFC posts and also to ensure rota quota in the 299 upgraded scale of RPFC-II.
j. Direct the respondents to consider the ration of DP:DR considering the juge stagnation in the post of EO/AO and in consideration of the DOPT guidelines regarding ratio of promotional posts and feeder posts. k. To grant such other reliefs as may be prayed for and the court may deem fit to grant, and l. Grant the cost of this Original Application."
4. The genesis of the grievance of the applicants, as outlined in this OA, is the Ministry's order dated 27.12.2016, conveying the approval of reorganization and cadre restructuring. The subsequent Office Order of EPFO dated 13.01.2017 and the notification of amended rules dated 16.03.2018 are an offshoot of the Ministry's approval. Therefore, it would be appropriate to reproduce the Ministry's communication dated 27.12.2016 verbatim:- 35 O.A. No. 3139/2022

Sir, I am directed top refer to the Employees' Provident Fund Organization's letter No.HRD/61/2015/VOL.II/9972 dated 8.07.2016, No.HRD/61/2015/693 dated 21.07.2016, No.HRD/61/2015/VOL.I/807 dated 08.08.2016, No.HRD/61/2015/1254 dated 31.10.2016 and No.HRD/61/2015/1254 dated 6.12.2016 and to say that the Ministry after due examination of the proposal and with the concurrence of the Department of Expenditure (copy enclosed) hereby conveys the approval of the Ministry to the proposal of Organizational and Cadre Restructuring in EPFO as recommended & approved by the Central Board of EPF in its 210th, 212th and 213th meeting held on 09.12.2015, 29.03.2016 and 08.07.2016 on the basis of report of Sub-Committee and Anomaly Redressal cum Implementation Committee with certain modifications.
2. The proposal of Organization and Cadre Restructuring in EPFO as approved by the Central Board of EPF shall be subject to the following amendments in the proposal:
i. The designation of Regional Provident Fund Commissioner is replaced by Regional Provident Fund Commissioner-I, Existing designation of Regional Provident Fund Commissioner-I and Regional Provident Fund Commissioner-II will continue to be used.36 O.A. No. 3139/2022
ii. The designation of Deputy Provident Fund Commissioner be replaced by Regional Provident Fund Commissioner-II, Deputy Provident Fund Commissioner as proposed by Central Board shall be replaced by Regional Provident Fund Commissioner-II in the organization.
iii. The revised sanctioned strength of total posts of Regional Provident Fund Commissioner-II shall be 299.
iv. The revised sanctioned strength of Assistant Provident Fund Commissioner shall be 452.
3. As regards the post of Additional Central Provident Fund Commissioner in the Grade pay of Rs.10000/-, the total number of 13 posts (4 existing + 9 newly created) also includes posts to be filled on deputation basis which will be 4 in number.
4. The expenditure to the proposed Organizational and Cadre Restructuring in EPFO shall be met entirely from the internal budgetary resources of the Employees' Provident Fund Organization.
5. The proposal of Organizational and Cadre Restructuring in EPFO has the approval of the Hon'ble Ministry of Labour and Employment.

5. Shri Jayant Muthuraj, learned senior counsel assisted by Ms. Usha Nandini V., Mr. Biju P. Raman and Ms. Miranda Solomon, has argued that the entire exercise of review and subsequent restructuring of the cadre was on 37 O.A. No. 3139/2022 account of recognition of the fact that the cadres of EO/AO, numbering more than 2000, was suffering acute stagnation in their positions with very limited avenues of promotion available. Therefore, a well thought of conscious was taken to conduct an extensive review and restructuring. He has highlighted the fact that a holistic appreciation of the issue involved essentially requires recognizing the fact that the reason and objective of restructuring was to address the issue of stagnation. Keeping this principle and objective in mind, the Sub Committee had proposed the number of posts at the level of APFC, RPF and EPFC so that stagnation is not only addressed on a single occasion but an opportunity of regular promotion to higher levels is available. He has also argued that the CBT, which is the highest governing body of the EPFO had, thereafter, after careful examination, accepted the recommendations put forth and sought for the approval of the Government.
6. Learned counsel would point out that EPFO is a statutory body which runs various schemes in accordance with statutory provisions of those schemes and its own governance is through a CBT which has been constituted under EPF Act, 1952.38

7. Drawing attention to the specific averments made in the Original Application, learned counsel has argued that a detailed analysis in tabular form has been given to show how the recommendations as approved by CBT were to be implemented with respect to the cadre review and restructuring. Besides oral submissions, the learned counsel has also given a written brief highlighting that the restructuring of the cadre, which has also resulted in creation of supernumerary post, is illegal and contrary to the recommendations of the appropriate committees. In fact, very specific instances have been highlighted before us outlining as to what should have been the exact number of posts and how by not creating such a number of posts, further denial of promotion to EOs and AOs may be the outcome. As an illustration of what the learned counsel has argued, we are reproducing some of the salient points raised by him as follows:-
"III. MISUSE OF THE POWERS BY THE CENTRAL PROVIDENT FUND COMMISSIONER AND EPFO As on 29.03.2016, the existing position of APFC was only 456 out of 545 and even after the specific direction of CBT for implementation CR within 15 days., 206 EO/AOs were not promoted by the EPFO (Anomaly Committee Report- relevant Pg @226 & 213 CBT meeting-relevant Pe@ 234,238,242,243&247) 39 O.A. No. 3139/2022 EPFO appointed Direct recruitment candidates as APFCs as per the earlier strength in a haste, before implementing the Cadre Restructuring approved by the CBT 213 meeting, in violation of the specific direction.
Created 361 supernumerary posts which are ex- cadre posts w.e.f March 2017 instead creating 206 cadre posts and appointing 206 DP candidates as a One time measure. Accommodated 73 excess DR candidates in the supernumerary post along with DP candidates and thereby violated the decision did 08.07.2016 of 213th CBT meeting and Govt approval dt. 27.12.2016.
Framed separate recruitment rules of RPFC II without the approval of the Central Govt. and draft rules of APFC for only 452 posts, fully knowing that the approval accorded by the CBT as both being combined cadre. (Pages @107,110&111 of the reply by EPFO). Even after the Specific direction by the Minister/Chairman CBT, who chaired the 213 CBT meeting, for strict compliance of the CBT decision, the EPFO has not implemented the same. (Annexure A/20 filed with rejoinder and document filed with additional affidavit dated 14.09.2023) Without implementing para 10& 11 of the Anomaly Committee report and without notification of Recruitment Rules of APFC including the selection for RPFC II, Direct recruitment process of APFCs started with wrong DR vacancy position.
IV.EFFECT OF ILLEGAL AND IMPROPER IMPLEMENTATION OF CADRE RESRTUCTURING AND CREATION OF SUPERNUMERARY POSTS 206 EO/AOs were denied promotion to the permanent post.
361 Supernumerary posts were created and DP candidates and 73 excess DR candidates were accommodated in the Supernumerary posts. DR candidates who were appointed in the year 2016 in a haste, before implementing the CR, found place in the list of RPFC II, after the 40 O.A. No. 3139/2022 completion of 4 years, while the DP candidates who were kept out of the list enbloc and denied promotion to the permanent post and accommodated in the Supernumerary post are still struggling.
Even the 1999 hatch of EO/AO are still in the supernumerary post without a position in the roster of APFC. (Ground F,H&K @ Pg Nos 80,81&82) Had the 206 DP candidates were promoted in the year 2016. notionally w.e.f 09.12.2015, majority of them would have been placed in the senior Time Scale of RPFC II after 4 years and the remaining EO/AO of 1999 Batch and subsequent batches would have been promoted as APFC on the basis of year wise vacancy. The combined strength of vacancies, which had been expanded to 751 to assist promotion of the over-stuck EO/AO Cadre, was lowered from 545 to 452, which is 93 fewer than before and aggravated the stagnation in EO/AO cadre. Deprived the legal right of the DP candidates and curtailed the promotional avenues of the DP candidates behind them.
EPFO has not promoted a single EO/AO from 2017 onwards, ie, for the last 6 years except regularization of Supernumerary APFCs.
V. PROPER WAY OF IMPLEMENTATION OF ANOMALY COMMITTEE REPORT APPROVED BY CBT AND FINALLY MODIFIED AND APPROVED BY THE CENTRAL GOVT. AS PER LETTER DATED 27.12.2016 Existing strength -545 Creation 206-Total 751 (452 as APFC &299 as RPFC 11/DPFC) Recommendation - 206 post exclusively from DP candidates as one time measure (This include 103 posts entitled for the DR candidates)
1) Preparation of Seniority list of EO/AO and promotion of 206 from among them as APFC as a Onetime measure (regularisation w.e.f (09.12.2015) Then there will be 751 numbers in the combined cadre of APFC/RPFCII (545 existing+ 206 created).41 O.A. No. 3139/2022
ii) From among the 751 members, 299 senior numbers who had completed 4 years of service to be re designated as RPFC 11.(DPFC).
iii) On the basis of subsequent vacancies, appointments to be made in the cadre as per the ratio of DP& DR 1:1 Now the EPFO is proceeding with the Direct Recruitment process of 159 vacancies to the post of APFC with wrong DR vacancy position."
8. While making this elaborate narration, the singular fact, which has been highlighted by the learned counsel time and again, is that implementation of the review and restructuring done by the EPFO is not in accordance with the scheme for such restructuring as had been approved by the CBDT.

Learned counsel has time and again mentioned that the EPFO has acted contrary to the directions of the Central Government as well as those given by the CBDT and the recommendations have been altered or tinkered so as to frustrate the entire exercise of review and restructuring. In case EPFO was to deviate from the same, it required further approval of the Central Government in terms of the provisions of the EPF Act.
10. Mr. Sanjay Ghose, learned senior counsel assisted by Ms. Asha Goalan Nair, Ms. Nivedita Nair, Ms. Vagmi Singh and Mr. Mayank Batra, learned counsel for the 42 O.A. No. 3139/2022 respondents, has, at the outset, questioned the maintainability of this Original Application and has argued that what the applicants seek from this Tribunal is to assume the role of administration, specifically the statutory powers of the EPFO and the authority vested in the Government of India with respect to giving directions to the EPFO.

Learned counsel has explained that cadre restructuring is not merely an exercise of determining number of posts and positions but it involves laborious exercise of examining workload and functionality of each and every position. Such an exercise has to necessarily follow amendment in the rules, reconstitution, restructuring of the cadres, including merger and amalgamation. He has emphatically stated that these activities squarely fall within the domain and jurisdiction of the executive; the courts have consciously and consistently refrained from entering into this domain as that would strike at the very basis of separation of executive and judicial powers.
12. On the facts of case, learned counsel has explained that the cadre restructuring has taken place strictly in 43 O.A. No. 3139/2022 accordance with the approval accorded by the Ministry and the applicants herein, including other members of the applicant association, have benefitted immensely from this proposal and a large number of them have been promoted. The respondents, i.e. Union of India through the Ministry of Labour & Employment as also the EPFO, have their own independent jurisdiction and administrative discretion in the matter. Explaining, he submits that while they are duty bound to give due consideration to the recommendations made, they are certainly bound to accept the same in totality or in the form in which they are made. The respondents have the right to vary or modify some or all of the recommendations while taking a final decision thereupon. In the instant case, the issue was restructuring of the cadres and while deciding such an issue, a holistic view of the entire organization, including applicable rules and laws is required to be taken so that no anomalies get created in the future.
13. Learned counsel, orally as also through the written submission, has tried to clarify as to how the number of vacancies and the cadre strength of DPFC, RPFC and EPFC are determined and further as to how and why the Ministry 44 O.A. No. 3139/2022 has made certain amendments to the proposal submitted to it.
14. Learned counsel argues that the intent of the applicants in agitating the issue in the present OA, appears to be to put an embargo to the direct recruitment process so that the existing vacancies get filled up only by way of promotion which would be contrary to the rules as also against the propriety of administration which requires that balance be maintained between direct recruits and promotees. He submits that, in any case, the proposal as approved, envisages creation of supernumerary posts to address the issue of stagnation. Therefore, it is beyond comprehension as to what is the objection of the applicants. He expresses that the posts of direct recruitment do not relate to the applicants and hence they cannot be allowed to place an impediment before the respondents from filling up of direct recruitment posts.
15. Both the learned counsels have drawn support from some legal pronouncements which they have referred to both in the oral arguments as also the written submissions. However, in our considered view, since no 45 O.A. No. 3139/2022 intricate legal issue is involved, at this stage, we refrain from quoting the same.
16. Shri RV Sinha, learned counsel for the UPSC, has reiterated that UPSC had no further role to play in the matter as it had already discharged its duties and responsibilities strictly in accordance with rules. He has further submitted that UPSC was in complete support and agreement with the arguments put forth on behalf of the respondents.
17. Arguments were concluded on 07.11.2023 after the learned counsels for the parties had confirmed that they had nothing further to add to the oral arguments and written submission made by them. However, since a period of three months had gone by till the judgment could be written and pronounced, we thought it appropriate to give a brief hearing to the learned counsel once again in order to recapitulate the facts and the arguments which had been put forth before us. Therefore, OA was taken for brief hearing again under the heading 'for being spoken to' on 12.02.2024.
18. Right from the outset, we have nursed serious doubt with respect to our jurisdiction over the subject of this 46 O.A. No. 3139/2022 Original Application and expressed these to the learned counsels and sought their assistance. Obviously, the learned counsel for the respondents has agreed that the subject of this OA would be beyond the purview of the judicial review; whereas the learned counsel for the applicants has strongly argued that the Tribunal would be within its powers to intervene in the matter. The Tribunal draws its jurisdiction and authority from Section 14 of the Administrative Tribunals Act, 1985, which is reproduced below:-
"14. Jurisdiction, powers and authority of the Central Administrative Tribunal.-
(1) Save as otherwise expressly provided in this Act, the Central Administrative Tribunal shall exercise, on and from the appointed day, all the jurisdiction, powers and authority exercisable immediately before that day by all courts (except the Supreme Court in relation to-
(a) recruitment, and matters concerning recruitment, to any All-India Service or to any civil service of the Union or a civil post under the Union or to a post connected with defence or in the defence services, being, in either case, a post filled by a civilian;
(b) all service matters concerning-
(i) a member of any All-India Service; or
(ii) a person [not being a member of an All-
India Service or a person referred to in clause (c)] appointed to any civil service of the Union or any civil post under the Union; or 47 O.A. No. 3139/2022
(iii) a civilian [not being a member of an All- India Service or a person referred in clause
(c)] appointed to any defence services or a post connected with defence, and pertaining to the service of such member, person or civilian, in connection with the affairs of the Union or of any State or of any local or other authority within the territory of India or under the control of the Government of India or of any corporation [or society] owned or controlled by the Government;
(c) all service matters pertaining to service in connection with the affairs of the Union concerning a person appointed to any service or post referred to in sub-clause (ii) or sub-clause
(iii) of clause (b), being a person whose services have been placed by a State Government or any local or other authority or any corporation [or society] or other body, at the disposal of the Central Government for such appointment. [Explanation - for the removal of doubts, it is hereby declared that references to "Union" in this sub-section shall be construed as including references also to a Union territory.] (2) The Central Government may, by notification, apply with effect from such date as may be specified in the notification the provisions of sub-section (3) to local or other authorities within the territory of India or under the control of the Government of India and to corporations [or societies] owned or controlled by Government, not being a local or other authority or corporation [or society] controlled or owned by a State Government:
Provided that if the Central Government considers it expedient so to do for the purpose of facilitating transition to the scheme as envisaged by this Act, different dates may be so specified under this sub-section in respect of different 48 O.A. No. 3139/2022 classes of, or different categories under any class of, local or other authorities or corporations [or societies].
(3) Save as otherwise expressly provided in this Act, the Central Administrative Tribunal shall also exercise, on and from the date with effect from which the provisions of this sub-section apply to any local or other authority or corporation [or society], all the jurisdiction, powers and authority exercisable immediately before that date by all courts (except the Supreme Court in relation to-
(a) recruitment, and matters concerning recruitment, to any service or post in connection with the affairs of such local or other authority or corporation [or society];
and
(b) all service matters concerning a person [other than a person referred to in clause
(a) or clause(b) of sub-section (1) ] appointed to any service or post in connection with the affairs of such local or other authority or corporation [or society] and pertaining to the service of such person in connection with such affairs."
19. Let us revisit the issue. The CBT of the EPFO decided to undertake an exercise for reorganization and restructuring of the cadre with a view to resolve the issue of stagnation and constituted a Committee to study it and make appropriate recommendations. This was followed by constitution of further Committee to look into the anomalies. The CBT enjoyed unquestioned power and authority to take such a decision. Thereafter, a comprehensive proposal was submitted to the appropriate 49 O.A. No. 3139/2022 Ministry for its approval, an action again within the purview of rules and instructions. The Ministry approved the proposal with certain conditions/instructions for implementation. It is no one's case that the Ministry was not empowered to do so. So how does our jurisdiction get invoked?

We reiterate that the subject is restructuring of the cadre and we are conscious that we should desist in interfering in such an exercise unless violation of any statutory provision of rules is demonstrated. That is not the case here. Moreover, even the principles of natural justice do not get attracted. There is also a stark contradiction in the pleadings and the arguments put forth before us. On the one hand, the approval accorded by the Ministry vide its letter dated 27.12.2016 is being challenged and on the other hand, it has been extensively and vehemently argued that the implementation made by EPFO is not strictly in accordance with the approval accorded by the Ministry. Further, the Ministry's approval is impugned with respect to the number of posts/strength sanction of RPFC, APFC etc. and identical is the challenge, i.e. number of posts created to the notifications issued by the Central Provident Fund Commissioner. 50 O.A. No. 3139/2022
21. The question before us is are we entitled to determine the number of posts to be created and sanctioned? Unhesitatingly, we would answer this question in the negative. We would be blatantly encroaching upon the domain of the administration if we were to go into these micro issues. Further, as argued by learned counsel for the applicants vehemently and repeatedly, if the EPFO did not strictly adhere to the directions of the Ministry, it is squarely upon the shoulder of the competent authority in the Ministry to take notice of the same and respond appropriately. We cannot sit as a supervisor and auditor over the action of the respondents unless contravention of any statutory provisions is involved, and that is certainly not the case out here.
22. We do observe that pleadings in the matter are voluminous and very extensive arguments have been put before us but we would not dwell any further upon them as we would be going against our own observations recorded above by commenting upon the merits of the exercise of cadre restructuring which has led to creation of some number of posts which is not to the liking of the applicants. However, we would just leave with the small observations that adequate number of posts to address the 51 O.A. No. 3139/2022 issue of stagnation appear to have been created but the applicants are still not satisfied because these have been created in supernumerary capacity; whereas they want these to be permanent posts. The applicants are certainly not entitled to dictate as to how restructuring of organization should take place and what should be the nature of posts to be created or abolished. We should not assume jurisdiction of running an administration as its administrator. The Relief Clause, i.e. Para 8 of the OA runs into sub paras a to l. Barring the standard paras k and l, seeking "grant" of "such other reliefs" and "grant of cost", all the other ten prayers pertain strictly to the domain of administration and none calls for a judicial review or adjudication by the Tribunal. We reiterate that the subject of this OA is certainly not amenable to judicial review and we would not allow ourselves to exceed our jurisdiction.
23. In view of what has been outlined and detailed above, the OA, being devoid of merits, stands dismissed. Pending MAs also stand disposed of.
