This is an application seeking early hearing of the writ petition as well as grant of interim parole to the petitioner for a period of three weeks to look after his family including two minor daughters.

It is stated in the application that the petitioner‟s wife has been diagnosed with typhoid on 14.09.2022 and her condition is not improving.

Ms Rao, learned ASC has filed a status report wherein the factum of Ms Savita having typhoid has been verified. Ms Rao also handed over a latest Nominal Roll which shows that the petitioner has undergone incarceration for 7 Years 9 Months and has a remission of 5 Months and 8 Days. However, the petitioner is a life convict.

For the reason that the petitioner has to take care of his ailing wife and the fact that the petitioner has two minor daughters, I am inclined to allow Signature Not Verified Digitally Signed byAMIT ARORA Signing Date:28.09.2022 19:14:53 the application. The petitioner is granted parole for a period of three weeks from the date of his release subject to following conditions:

(a) The petitioner during the period of his parole shall reside at S-93/8, Khasra No. 24/1, Nihal Vihar, Nangloi, New Delhi i.e. the address verified by the respondent.
(b) The petitioner shall furnish a personal bond in the sum of Rs. 25,000/-

(Rupees Twenty Five Thousand Only) with 01 surety in the like amount, to the satisfaction of the Jail Superintendent;

(c) The petitioner shall present himself before the SHO of the nearest Police Station on first Monday of every month at 10:30 am to mark his presence. However, he will not be kept waiting longer than half an hour for this purpose;

(d) The petitioner shall furnish to the concerned S.H.O. a cellphone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;

(e) If the petitioner has a passport, he shall surrender the same to the Jail Superintendent;

(f) The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in pending cases, if any;

(g) Upon expiry of the period of parole, the petitioner shall surrender before the Jail Superintendent.

In view of the aforesaid, the prayer made in the petition being W.P.(CRL) 1845/2022 has become infructuous. In case the petitioner is eligible/entitled to parole, subsequently, he is at liberty to take appropriate steps in accordance with law.

The petition is disposed of accordingly.
