Heard both the sides.

The Test Identification Parade Chart has been made available to the Court and that appears at Flag 'X'. The case is under Section 394 of the Indian Penal Code and relates to robbing the travelers in a taxi which was being driven by the informant. The petitioner was not named in the F.I.R. but subsequently he was suspected to have his hand on account of the Cellular Phone being found in his possession. The T. I. Parade chart indicates that the petitioner was put on the Test Identification Parade and he was identified. As may appear from paragraph 129 of the case diary, the informant knew the petitioner from before the occurrence and had a relationship of such an extent with the petitioner so as to lending his Cellular Phone for making calls. It is contended that the implication of the petitioner is wrong and false on account 2 of trade rivalry as both the informant and the petitioner are the taxi drivers and they operate their taxies from Barauni Junction.

Regard being had to the facts and the circumstances as also the contention, let the petitioner Ramanuj Singh alias Nunu Singh be released from custody on his furnishing a bond of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in Birpur P.S. Case no. 35 of 2008.
