1. This is an application under order XXXIX Rule 2 A r/w section 151 of the Civil Procedure Code, 1908 ['CPC'] r/w section 11 and 12 of the Contempt of Courts Act, 1971, filed by the plaintiffs against the defendant no. 5 for wilful disobedience/violation/breach of order dated 08.02.2024 passed by this court.
2. Learned counsel for defendant no.5 states that the retrieved data and/or original source code of the deleted AWS account has been filed with the learned Mediator on 11.01.2025.
3. He states that plaintiff may verify the said data to satisfy itself with respect to the recovery of the original source code.

4. The plaintiff no.2 who appears in person, states that the AWS account on which the original source code/software was hosted, not only included the plaintiffs' own patent-filed source code but also had critical tech integrations and commercial collaborations with multiple stakeholders like various banks, Mastercard and global suppliers.
5. He states that building the network of the banks, Mastercard and global suppliers on the AWS account was a tremendous effort which took him almost 2 to 3 years.
6. He states that even if defendant no. 5 was to provide the parties a new AWS account, mere installation of the source code, in the absence of the integration with the third-parties would not restore the position of the deleted AWS account.
7. He states that verifying the retrieval of the original source code on the pen drive filed with the mediator would not restore the status quo ante and therefor would not be due compliance of the orders of the Court which have been violated by the defendant no. 5. He therefore declines the offer to verify this data.
8. The defendant no.5 is directed to address submissions keeping in view this stand of the plaintiff no. 2 and the affidavit dated 24.08.2025.
9. Learned counsel for defendant no.5 states that he will file his reply, if any, to the plaintiff no.2's affidavit dated 24.08.2025
