                                                      Mr. Uttiyo Mallick, Adv.
                                                     Mr. Sayan Banerjee, Adv.
                                                          ...for the respondent

The Court: The petitioner has filed the present application under Section 29-A of the Arbitration and Conciliation Act, 1996, seeking extension of time period for conclusion of the arbitral proceedings and publication of the award.

It is the case of the petitioner that this Court vide order dated 18.01.2022 appointed the sole Arbitrator to adjudicate the disputes between the parties. The pleadings were completed on 22.07.2022. With the consent of the parties, the mandate of the tribunal was thereafter extended by a further period of six months up to 20.01.2024. Subsequently, this Court vide order dated 09.05.2024, 11.11.2024 and 19.05.2025 extended the 2 mandate of the arbitral tribunal by six months on each occasion. The mandate has expired on 19.11.2025.

Learned Counsel for the petitioner submits that the final arguments have been concluded and the parties have been directed to file their written submissions which have already been filed. It is submitted that only the publication of the award remains, and therefore, an extension of three months is sought to enable the arbitral tribunal to publish the award.

Learned Counsel for the respondent does not oppose the present application.

This Court notes that the arbitration commenced on 18.01.2022 and the mandate has been extended on four occasions. However, in view of the fact that the final arguments have concluded and only the pronouncement of the award remains, the mandate of the arbitral tribunal is extended further for a period of three months from today to enable the learned Arbitrator to publish the award.

The arbitral tribunal is requested to make all endeavours to publish the award within the extended time period.

With the aforesaid observation, the present arbitration petition is disposed of.

Affidavit of service and notice of motion are taken on record.
