1. The present batch of writ petitions involve common question of law and facts and, as such, they are being considered and decided by this common order.

2. The State has filed its return in WPS Nos.3533, 1943, 1959 & 2162 of 2017.

3. At the very outset, Shri R.K. Gupta, learned Dy. Advocate General, appearing for the State, would pray that the State Government may be permitted to adopt the return filed in the aforesaid four petitions in all other similar matters.

4. Considering the commonality of issue, the State Government is permitted to adopt the return filed in WPS Nos.3533, 1943, 1959 & 2162 of 2017 in all the cases. Accordingly, it is treated that the State has filed the return in all the cases.

5. The present batch of writ petitions have been preferred by the Assistant Teacher (Panchayat) or Teacher (Panchayat) or Lecturer (Panchayat), as the case may be, who belong to the cadre of Teacher (Panchayat) in the Department of Panchayat and Rural Development, Government of Chhattisgarh and were appointed by the respective Janpad Panchayats or Zila Panchayats.

6. The present batch of petitions have filed by four sets of petitioners e.g.

(i) those who were appointed under the provisions of the Madhya Pradesh (now Chhattisgarh) Panchayat Shiksha Karmi (Bharti Tatha Seva Ke Sarten) Niyam, 1997 (for short 'the 1997 Niyam') at the time when there was no statutory requirement of passing B.Ed. or D.Ed. for selection on the post of Assistant Teacher (Panchayat) or Teacher (Panchayat) or Lecturer (Panchayat). These petitioners have already been confirmed/ regularised and are getting the revised pay scale together with increments in terms of the State Government's circular dated 17-5-2013.

(ii) those candidates who were appointed under the provisions of the Chhattisgarh Panchayat Shiksha Karmi 71 (Bharti Tatha Seva Ke Sarten) Niyam, 2007 (for short 'the 2007 Niyam') by benefiting from the relaxation clause provided under Note 2 of Schedule II inasmuch as they were appointed even without having B.Ed./D.Ed. qualification because sufficient number of candidates having such qualification were not available. These petitioners have also been confirmed/ regularised and are getting the revised pay scale together with increments in terms of the State Government's circular dated 17-5-2013.

(iii) those candidates who have been appointed under the provisions of the 2007 Niyam and have been confirmed and completed 8 years service after issuance of the impugned order dated 6-5-2016 & 8-3-2017, however, they have not been granted benefit of revised pay scale.

(iv) those candidates who have been appointed under the 2007 Niyam and are confirmed in the service, but have not been granted benefit of revised pay, as they have not completed 8 years service, however, they were allowed annual increment, which has now been withdrawn after passing the impugned order dated 6-5-2016 & 8-3-2017. Consequently, these petitioners have been now brought on the basic pay scale.

In all the cases where the petitioners were allowed benefit of revised pay and/or annual increment the same has been withdrawn after issuance of the impugned orders, however, they are currently obtaining benefit of revised pay scale or annual increment on the strength of interim order passed by this Court.

8. The controversy brought before this Court is in relation to the petitioner's entitlement to the revised pay scale or annual increment, which were made admissible to them or for which they claimed to be entitled on the strength of State Government's circular dated 17-5-2013, however, before adverting to the provisions made in various circulars of the State Government it would be necessary to refer to the relevant statutory provisions which were applicable at the time of their appointment.

9. The first recruitment rules were framed by the State Government in the erstwhile State of Madhya Pradesh in the year 1997 by the name Madhya Pradesh (now Chhattisgarh) Panchayat Shiksha Karmi (Bharti Tatha Seva Ke Sarten) Niyam, 1997. In the said Rules, the eligibility qualification for appointment on the post of Shiksha Karmi Grade I or Shiksha Karmi Grade II or Shiksha Karmi Grade III without providing any requirement of possessing certificate of B.Ed. or D.Ed. passed. As a result, the candidates appointed under the 1997 Niyam were not distinguished on the basis as to whether they have the qualification of B.Ed./D.Ed. or not and all such teachers were allowed the same pay scale and allowances irrespective of having passed B.Ed./D.Ed.

10. The next set of Rules were promulgated in the year 2007 to be known as Chhattisgarh Panchayat Shiksha Karmi (Bharti Tatha Seva Ke Sarten) Niyam, 2007. Rule 8 thereof and note 2 appended to Schedule II are most relevant for these petitions, therefore, they are reproduced hereunder for ready reference :

8. Probation:- Every selected candidate by direct recruitment to the post of Shiksha Karmi shall be appointed for a specific school on probation for two years which may be extended up to five years so that Shiksha Karmi may work for the entire probation period in the same school. At the end of every year appointing authority will assess the work of Shiksha Karmi.

After the probation period of two years on the basis of conduct and work of Shiksha Karmi the Panchayats may terminate the probation period. In case the work of Shiksha Karmi is not found satisfactory then the probation period may be extended for one to two years thereafter their work shall be assessed after the end of the extended period. If their services are not found satisfactory their services shall be terminated.

Provided that the appointed Shiksha Karmi if does not obtain the prescribed educational qualification after five years of joining shall not be entitled for increments till he obtains the required qualification.

11. All the petitioners who have been appointed after coming into force of the 2007 Niyam have availed the benefit of relaxation provided in note 2 to Schedule II mentioned above. They were, thus, appointed because sufficient number of candidates having B.Ed./D.Ed. qualification were not available.

12. The third set of Rules were promulgated in 2012 known as the Chhattisgarh Teacher (Panchayat) Cadre (Recruitment and Conditions of Service) Rules, 2012 (for short 'the 2012 Niyam'). Rule 8 of the 2012 Niyam provides for probation of a candidate appointed under the rules. The same is reproduced hereunder for ready reference :

8. Probation:- Every candidate selected to the post of Teacher (Panchayat) cadre by direct recruitment shall be appointed in a particular school for a period of two years on probation which may be extended upto 5 years. At the end of every year Appointment Authority shall assess the work of Teacher (Panchayat) cadre.

After the probation period of two years, on the basis of conduct and work of Teacher(Panchayat) cadre, the Panchayat may terminate the probation period. In case the work of Teacher (Panchayat) cadre is not found satisfactory then the probation period may be extended from one to three years. Thereafter their work shall be assessed after the end of the extended period. If there services are not found satisfactory their services shall be terminated:

Provided that the appointed Teacher (Panchayat) cadre shall be entitled for increments only after the completion of probation period.

13. By notification dated 19-11-2012 Note 2 (a) was inserted in the schedule to provide that if sufficient number of candidates having B.Ed. qualification are not available for the post of Lecturer (Panchayat) then relaxation can be granted, but such candidates have to acquire the qualification within a period of 3 years from the date of appointment.

14. Admittedly, all the petitioners appointed under the 2007 Niyam have been confirmed or regularized in the service upon successful completion of their probation period. Out of the confirmed/regularized candidates, all such who have completed 8 years of service before 6-5-2016 have been provided benefit of the State Government's circular dated 17-5-2013.

15. The contents of the circular dated 17-5-2013 are quoted below for ready reference :

16. In the year 2016 some Zila Panchayats and the Union representing Teachers (Panchayat) cadre moved representation seeking guidance as to whether such Teachers having not acquired B.Ed./D.Ed. qualification are still entitled for regularization. The State Government answered this query by issuing a circular dated 6-5-2016 which is under challenge in 76 some of the petitions. Referring to Rule 8 of the 2007 Niyam, it is mentioned in the second paragraph of the circular that such candidates who have not acquired the qualification within 5 years from the date of appointment will not be entitled for annual increment. In the last part of paragraph three, the circular says that Teachers (Panchayat) Cadre will be entitled for annual increment only upon completion of the probation period. It also says in third paragaph that relaxation is also provided under note 2 (a) inserted by notification dated 19-11-2012, however, the regularized candidates are required to obtain the qualification within 3 years, but the termination of a candidate can happen only upon unsatisfactory service during the period of probation. In the conclusion, the circular says that a candidate shall be entitled to be regularized only after acquisition of B.Ed./D.Ed. qualification, therefore, such of them who have not acquired this qualification are not entitled to be regularized or given benefit of annual increment or transfer.

17. In January, 2017 the Zila Panchayat, Janjgir-Champa made a communication to the Directorate (Panchayat) again seeking guidance as to whether untrained Teachers i.e. those who do not have the B.Ed./D.Ed. qualification are entitled to revised pay scale on completion of 8 years service. The letter dated 25-1-2017 by the Zila Panchayat to the Directorate (Panchayat) has also been filed by the petitioner in WPS No.3533 of 2017. According to the Chief Executive Officer, since Teachers (Panchayat) Cadre are getting the benefit of higher pay scale in accordance with the State Government's circular/rule but some of them have not acquired B.Ed./D.Ed. qualification, therefore, whether in view of the circular dated 6-5-2016 they are entitled to the benefit of revised pay scale. The Chief Executive Officer, Zila Panchayat, never sought any guidance as to the admissibility of increment to such candidates as the word 'increment' or ' vetanvriddhi' is not referred in the communication, however, the Commissioner-cum-Director, Directorate of Panchayat has issued the impugned communication dated 8-3-2017 addressed to the Chief Executive Officer, Zila Panchayat, Janjgir- Champa, endorsing the same to all the CEOs of Zila Panchayats and Janpad Panchayats of the State informing that when untrained Teachers 77 (Panchayat) Cadre are not entitled for annual increment and their period of probation cannot be concluded, therefore, on completion of 8 years service they are not entitled for the time pay scale/pay scale at par with the Government Teachers.

18. Assailing both the impugned letters, learned counsels appearing for the respective petitioners would argue that :

 those petitioners who were already enjoying the benefit of time scale pay with increment, the same cannot be withdrawn or stopped without following the principles of natural justice;

 the petitioners having already been confirmed/ regularized on successful completion of the period of probation and having been allowed the benefit of time scale pay/revised pay scale pursuant to the State Government's order dated 17-5-2013, which was issued by the State Government in the name of the Governor of the State of Chhattisgarh, based on a cabinet decision, the same cannot be withdrawn by communication from the office of the Commissioner- cum-Directorate (Panchayat) without there being any policy decision by the Cabinet; and  on correct interpretation of Rule 8 and note appended to the Schedule II of the 2007 Niyam also the petitioners are entitled for the time scale pay/revised pay scale and increment.

19. Per contra, learned Dy. Advocate General appearing for the State, would read out the provisions contained in the 2007 Niyam and the 2012 Niyam to argue that :

 the word 'increment' occurring in the proviso to Rule 8 of the 2007 Niyam would include revised pay scale 78 inasmuch as if a person is not entitled to increment he cannot expect to get the better package in the shape of revised pay scale;

 the petitioners having obtained the appointment despite lacking qualification in terms of the Rules, they are governed under the proviso to Rule 8 and are estopped from claiming any better right than the one which flows from the Rules; and  entitlement of increment and regularization are two different issues, therefore, despite having been confirmed or regularized the petitioners would not be entitled for increment or time scale pay/revised pay scale.

20. Having heard learned counsel appearing for the parties at length and having given anxious consideration to the issues brought before this Court, it follows that the 2007 Niyam allowed relaxation concerning acquisition of B.Ed./D.Ed. qualification in note 2 of Schedule II, however, proviso to Rule 8 provides that if any Shiksha Karmi fails to obtain the prescribed educational qualification after five years of joining, he shall not be entitled for increment till he obtains the required qualification. The main part of Rule 8 about the probation speaks of termination of service if service of Shiksha Karmi during the period of probation is not satisfactory. Thus, neither in the proviso nor in note 2 it is mandated that for not obtaining the required qualification the Shiksha Karmi can be terminated or would not be entitled for regularization. It is probably for this effect of the Rule, all the petitioners were confirmed or regularized at the end of their satisfactory completion of probation period even though they had not acquired the B.Ed./D.Ed. qualification by that time.

21. All such Shiksha Karmis who were already confirmed or regularized and were coming within the zone of consideration for availing the benefit of increment and time scale pay/revised pay scale in terms of the circular 79 dated 17-5-2013 were allowed the benefit and were getting advantage of the same for the last about three years.

22. Even under the 2012 Niyam relaxation for acquiring the qualification was incorporated by notification dated 19-11-2012 with condition that such candidates are required to attain the qualification within three years, however, the Rule does not provide for the consequences, if such appointee fails to attain the qualification. Even under the proviso to Rule 8 of the 2012 Niyam a candidate is entitled for increment only after completion of the probation period, which has not been interlinked with the issue of acquisition of qualification.

23. If the provisions contained in the 2007 Niyam and the 2012 Niyam are placed in juxtaposition, it is manifest that the 2012 Niyam makes a more beneficial provision for the Shiksha Karmis than the 2007 Niyam because under the 2007 Niyam the Shiksha Karmi will not be entitled for increment if he fails to acquire the qualification, but under the 2012 Niyam a Shiksha Karmi who is appointed even without the subject qualification by way of relaxation as per the notification amending the rules dated 19-11-2012, he will not loose the increment, which is admissible to him after satisfactory completion of probation period.

24. It is important to notice that under both the Rules relaxation is provided, however, under the 2012 Niyam consequence of non obtaining of the qualification within 3 years is not provided. On the other hand, under the 2007 Niyam a person who is not qualified is yet entitled to be confirmed/regularized but he will not get annual increment.

25. It is settled law that if the statute provides for some condition or requirement to be fulfilled within particular time, but it does not provide for consequence for not having fulfilled the condition, the provision is stated to be directory and not mandatory. Here it will be apt to refer to the observations made by the Supreme Court in U.P. State Electricity Board v. Shiv Mohan Singh and Another 1, wherein the Supreme Court while considering the case of Apprentice within the frame work of 1(2004) 8 SCC 402 80 Apprentices Act, 1961 held that by reason of non-registration of the contract of apprenticeship, the same does not become a nullity. If it is to be held that by reason of non-registration of such contract of apprenticeship the contract itself comes to an end, it would be detrimental to the interest of the apprentices, which would frustrate the object of the Act.

26. The Supreme Court further observed that the definition of 'apprentice' nowhere states that an apprentice with a view to obtain the benefits of the said Act must also be registered. It was then observed that no provision of the Act or the rules framed thereunder was brought to our notice to show that non-registration of the contract of apprenticeship or violation and/or neglect on the part of the employer to comply with the other provisions of the Act it would result in invalidation of the contract.

27. In the subject rules also, as found by this Court, the consequence of non acquisition of the qualification has not been provided. Thus, in view of the decision rendered by the Supreme Court in State Bank of Patiala and Others v. S.K. Sharma 2, if the appointing authority so desires, it can waive or ignore the issue of non acquisition of qualification and proceed to grant benefit of time pay scale/revised pay scale.

28. In U.P. State Electricity Board (supra) the Supreme Court held that it is now well-settled principle of law that if the language used in a statute is capable of bearing more than one construction, the true meaning thereof should be selected having regard to the consequences resulting from adopting the alternative constructions. A construction resulting in hardship, non-fulfillment of the purpose for which statute has been brought in force should be rejected and should be given that construction which avoids such results.

29. This Court has reached to the above conclusion because it is probably for this legal position, the State Government while issuing the circular dated 17-5-2013 did not put any embargo on a candidate to have the qualification of B.Ed./D.Ed. before being entitled to get the increment or 2(1996) 3 SCC 364 81 time scale pay/revised pay scale. Only requirement in the circular is that the appointee should complete 8 years of satisfactory service on a particular cadre for being entitled to get the revised pay scale.

30. It is useful to refer the law laid down by the Supreme Court in P.T. Rajan v. T.P.M. Sahir and Others 3, wherein it is held that a statute, as is well known, must be read in the text and context thereof. Whether a statute is directory or mandatory would not be dependent on the user of the words "shall" or "may". Such a question must be posed and answered having regard to the purpose and object it seeks to achieve.

31. The documents placed before this Court (in form of compilation) would depict that the circular dated 17-5-2013 was issued pursuant to a cabinet decision and was expressed to have been issued by order and in the name of the Governor of the State of Chhattisgarh whereas the present impugned communications dated 8-3-2017 or 6-5-2016 have been issued either by the Directorate (Panchayat) or the Secretary to the Government of Chhattigarh, Department of Panchayat, but have not been expressed to be issued by order and in the name of the Governor or pursuant to any cabinet decision. The circular dated 17-5-2013 would, thus, stand on an improved legal pedestal and the benefit arising therefrom cannot be nullified, diluted or withdrawn. If the Government desires to withdraw the benefit flowing from the said circular, the decision should be taken in the same manner and not in form of any clarification by a communication, which is legally and legislatively inferior.

32. On this score, I may profitably refer to the decisions rendered by the Supreme Court in Gullapalli Nageswara Rao and Others v. Andhra Pradesh State Road Transport Corporation and Another 4, State of Bihar and Others v. Kripalu Shankar and Others 5 and Jaipur Development Authority and Others v. Vijay Kumar Data and Another 6, wherein it is succinctly held that the executive decision of the Government has to be expressed in the name of the Governor, therefore, 3(2003) 8 SCC 498 4AIR 1959 SC 308 5(1987) 3 SCC 34 6(2011) 12 SCC 94 82 the communications dated 6-5-2016 & 8-3-2017 are neither the executive decision of the Government nor they would be treated at par with the circular dated 17-5-2013.

33. Even if it is true that the circular dated 17-5-2013 was not dealing with an issue as to whether the revised pay scale would be admissible to a non B.Ed./D.Ed. appointee or not, by necessary implication, such facility should be deemed to have been automatically extended to the concerned appointee because they were already confirmed in the service, and there is no express exclusion of non B.Ed./D.Ed. teachers for extending the benefit. Even in the letter dated 6-5-2016 it is clearly mentioned in the last two lines of para 3 that the employees belonging to Teacher (Panchayat) cadre are entitled to annual increment after successful completion of the period of probation, which all the petitioners have already completed and express orders to this effect have been issued by each of the Chief Executive Officer. Once having said that upon successful completion of probation they will be entitled for annual increment, the letter dated 6-5-2016 makes the contradictory concluding remark that such Shiksha Karmis who have not acquired B.Ed./D.Ed. qualification shall not be entitled to regularization or annual increment. As a matter of fact, the communication dated 6-5-2016 is contrary to the Niyam, 2007 because the said Niaym nowhere provides that the appointee shall be confirmed only after obtaining the qualification of B.Ed./D.Ed.

34. There appears to be anomaly in para 3 and the concluding para of this letter and otherwise also, it is a settled proposition in service jurisprudence that an employee whose services are confirmed or regularized upon successful completion of period of probation is always held entitled to the pay scale or all such benefits which the Government has sanctioned for the post. Moreover, once having allowed the benefit to all such petitioners, the same cannot be withdrawn without following the principles of natural justice.

35. I may profitably refer to the decision of the Supreme Court rendered in O.P. Gupta v. Union of India and Others 7, wherein it is held that when the prejudicial order is made to deprive the Government servant of his increment, the Government has the duty to hear the concerned Government servant before any order is made against him. There has to be an objective consideration and assessment of all the relevant facts and circumstances. There is always 'the duty to act judicially' whenever the rules of natural justice are applicable. There is, therefore, the insistence upon the requirement of a 'fair hearing'.

36. It is a trite law that no order causing civil consequences can be passed, without observing the rules of natural justice. The Supreme Court in State of Punjab & Ors. v. Senior Vocational Staff Masters Association & Ors. 8 held thus in paras 20 & 21 :

20. It is by now well settled that no orders causing civil consequences can be passed, without observing rules of natural justice as it was held in Bhagwan Shukla v. Union of India & Ors. (AIR 1994 SC 2480) wherein it was held as under:

"3. We have heard learned counsel for the parties. That the petitioner's basic pay had been fixed since 1970 at Rs, 190 p.m. is not disputed. There is also no dispute that the basic pay of the appellant was reduced to Rs.181 p.m. from Rs.190 p.m. in 1991 retrospectively w.e.f. 18.12.1970. The appellant has obviously been visited with civil consequences but he had been granted no opportunity to show-cause against the reduction of his basic pay. He was not, even put on notice before his pay was reduced by the department and the order came to be made behind his back without following any procedure known to law. There, has, thus, been a flagrant violation of the 7(1987) 4 SCC 328 8AIR 2017 SC 4072 84 principles of natural justice and the appellant has been made to suffer huge financial loss without being heard. Fair play in action warrants that no such order which has the effect of an employee suffering civil consequences should be passed without putting the concerned to notice and giving him a hearing in the matter. Since, that was not done, the order (memorandum) dated 25.7.1991, which was impugned before the Tribunal could not certainly be sustained and the Central Administrative Tribunal fell in error in dismissing the petition of the appellant. The order of the Tribunal deserves to be set aside. We, accordingly, accept this appeal and set aside the order of the Central Administrative Tribunal dated 17.9,1993 as well as the order (memorandum) impugned before the Tribunal dated 25.7.1991 reducing the basic pay of the appellant From Rs.190 to Rs.181 w.e.f. 18.12.1970."

21. The order dated 16.07.2003 came to be made behind the back of vocational masters without following any procedure known to law. Thus, there has been a flagrant violation of the principles of natural justice and the respondents had been made to suffer huge financial loss without being heard. Fair play in action warrants that no such order which has the effect of an employee suffering civil consequences should be passed without putting the concerned to notice and giving him a hearing in the matter.

37. In the cases at hand, most of the petitioners have been granted the benefit of revised pay scale and increment, however, the same is sought to be withdrawn pursuant to the impugned communications, therefore, the same could not have been done without following the principles of natural justice, apart from the fact that the circulars are contrary to the Rules.

38. Even if it is the settled law that there can be different pay scales on the basis of qualification and untrained teachers may be allowed lower pay scale than the trained teachers, as held by the Supreme Court in Hukum Chand Gupta v. Director General, Indian Council of Agricultural Research and Others 9, such prescription of different pay scale has to be made by a statutory instrument and not by issuing clarificatory communication. As already discussed, even the said clarification communication nullifies or withdraw the benefit of circular dated 17-5- 2013, which was issued on the basis of a cabinet decision and was, thus, an executive action of the Government, which is as good as a statutory prescription.

39. The circular dated 17-5-2013 provides benefit of revised pay scale/time pay scale and increment to the Shiksha Karmis/ Teachers (Panchayat) cadre on personal basis and it is not conditioned on obtainment of any particular qualification. It neither amounts to functional or regular promotion, but only grants benefit of some pay scale, which is not linked to the qualification.

40. In Hukum Chand Gupta (supra) the Supreme Court held thus at para 16 :

16. The Assured Career Progression Scheme for the civilian employees was introduced on the recommendations of the Vth Central Pay Commission. It was introduced with a view to provide a 'Safety Net' to deal with problems of genuine stagnation and hardship faced by the employees due to lack of adequate promotional avenues. Under this scheme, it was decided to grant two financial upgradations on completion of 12 years and 24 years of regular service respectively. It was further provided that isolated posts in Group A, B, C and D categories which have no promotional avenues shall also qualify for similar benefits. Grant of financial upgradations under the ACP Scheme was, however, made subject to the conditions mentioned in 9(2012) 12 SCC 666 86 Annexure-I of Office Memorandum No.35034/1/97-Estt(D) dated 9th August, 1999. The conditions in Annexure-I indicate that ACP Scheme envisages only a placement in the higher pay-scale/grant of financial benefits (through financial upgradation). This is given to the Government servant concerned on personal basis only. It neither amounts to functional/regular promotion nor requires creation of new posts for the purpose. The aforesaid clarification makes it abundantly clear that the financial upgradation was granted to Shri Madan strictly inconformity with the aforesaid scheme. Therefore, the objections raised by the appellant were without any basis and wholly misconceived.

(Emphasis added)

41. It would, thus, follow that when grant of revised pay scale/ time scale pay and increment is on personal basis but is not designed or linked with the performance of the candidate to bring it at par with promotion and the candidate is only required to render the particular length of service, the obtainment of a particular qualification is irrelevant. It is precisely for this reason, the circular dated 17-5-2013 has not linked the benefit being admissible to the Teacher (Panchayat) cadre of having a particular qualification.

42. I am not impressed with the submission made by the learned counsel appearing for the State that the word 'increment' would include pay scale. They are two different concept of service jurisprudence. The annual increment is paid or made admissible even to an ad hoc employee. I may also notice the meaning of the word 'increment' explained by the Supreme Court in State Bank of India v. Presiding Officer, Central Government Labour Court, Dhanbad and Another 10 holding that an increment is in the same scale while a promotion is from one scale to a higher scale. A promotion from a lower grade to a higher grade, though both the grades may be in the same cadre, is not an 10AIR 1972 SC 2189 87 increment or increments by way of special promotion. Thus use of the word "special" would itself show that what is contemplated is advance increments in the same grade. It would, thus, naturally follow that grant of pay scale is the beginning to which an increment is added, which may or may not be granted to a particular pay scale, therefore, it would not mean that pay scale and increment are one and the same,

43. It is well settled principle of interpretation that the statute has to be read as it is and Court should not add or subtract or read any words into the statute which is not provided, therefore, if the legislature has consciously used the word 'increment' in the proviso to Rule 8 of the 2007 Niyam as well as the 2012 Niyam, this Court is not entitled to read the word 'increment' as pay scale so as to put the petitioners in a more disadvantageous position than the one contemplated by the legislature. Court is not entitled to snatch away the benefit admissible to an employee under the Rules by process of interpretation by doing violence to the language used by the legislature.

44. Now I shall consider the alternative submission made by the learned Dy.

Advocate General that in view of language employed under the proviso to Rule 8 that upon non achieving the required qualification a candidate is not entitled to get any increment, therefore, denial of increment flows from the Rules, and is not illegal.

45. While the language says so, it is to be considered that most of the petitioners have been allowed the benefit of increment which has now been taken away without giving any opportunity of hearing, therefore, this aspect of the matter has to be considered afresh by the State Government after providing opportunity of hearing to the concerned petitioners.

46. In the result, all the writ petitions are disposed of in the following terms :

1) Such Teachers (Panchayat) cadre who were already granted the benefit of time scale pay/revised pay scale and annual increment in terms of the circular dated 17-5-2013 are held entitled 88 to the pay scale/revised pay scale. Accordingly, the action of bringing them lower in the pay scale is quashed.

2) The issue about the petitioners' entitlement to get increment shall be considered afresh by the State Government within a period of 3 months from today. Before taking decision in the matter, the State Government shall hear the petitioners or some of them in the representative capacity. It is made clear that till the issue concerning entitlement of increment is decided, such petitioners who were already enjoying the benefit of increment, shall continue to get the same, which shall remain subject to the decision taken by the State Government in this regard.

3) Such petitioners who have completed 8 years of service and have already been confirmed/ regularized are held entitled to time pay scale/ revised pay scale, however, their entitlement to get increment shall automatically be considered when the State Government takes a decision in respect of such candidates who were already granted the benefit of increment. In the event the State Government decides to grant increment to the candidates, who were already paid the increment, this batch of petitioners will also be entitled for increment without requiring them to move afresh before this Court.

4) Such petitioners who were appointed under the 1997 Niyam when there was no condition of having B.Ed./D.Ed. qualification are held entitled to the revised pay scale/time pay scale as well as increment and the impugned action withdrawing the said benefits from such petitioners is quashed. They shall continue to get all the benefits, which they were enjoying just before issuance of the impugned communications.
